Justice Carlisle Greaves

(CNS): Justice Carlisle Greaves held no punches Wednesday as he handed down the maximum term of ten years to Judith Douglas for her conviction for obtaining property by deception. Douglas was found guilty by a jury on Tuesday of conning Nathaniel Robb, a US citizen, out of almost CI$1.9 million by falsely claiming that she could secure Caymanian status for him. The judge said the name “Judas” was ringing in his ears in this case, adding, “Judith ‘Judas’ robbed Mr Robb.”

The judge found that the mitigation factors presented to him on behalf of Douglas did not warrant reducing the time she should receive, but he outlined a long list of aggravating factors, which led to the maximum sentence allowable under the law. As he outlined Douglas’ crimes, he said that Robb, her victim, was a diver “who could not draw breath under her ocean of lies”.

Justice Greaves said Douglas was relentless in her crime and that society needed to be protected from her because given her history of offending, she was unlikely to stop. He said he had presided over many fraud cases in his time but this case was special. “I am at pains to remember a defendant better qualified than this defendant to be referred to as a full time fraudster,” he added.

The judge said she had “left the complainant a broken man” who had just over $19 in his account when he came to give evidence.

As he outlined the many aggravating factors in this case, Justice Greaves noted her previous convictions for similar crimes, and that she had actually embarked on this offence while she was on bail and under investigation for those offences. Even as she was convicted she was calling Robb from jail for more money.

“She has shown absolutely no remorse and demonstrated a high degree of selfishness, and even had audacity to declare herself a victim of the victim,” he added, as he described her defence as “absurd”. He said that despite the clear view of the WhatsApp messages, she accused Robb of embezzling people without any evidence.

The judge said her actions had undermined the immigration system, calling into question officers and board members after she suggested, “without a scintilla of evidence”, that they were all susceptible to bribes. A further aggravating element was that up to this day “not one dime of that $1.9 million has been paid back or recovered”, he said.

Justice Greaves told Douglas that there would be no slap on the wrist. “You and others of your type must understand that the sentences shall be high,” he said. “I am of the view that society… needs to be protected from you as long as practical according to law,” he added, before handing down the ten-year sentence.

Douglas wept as the sentence was delivered. Earlier in the hearing, when asked if she had anything to say before the judge passed sentence, she had pleaded for leniency. She said she had been in Fairbanks for over a year and it was really hard. She was “not being treated the best” and was now on medication for depression and anxiety as well as being unable to sleep.

All you people saying Robb should also be charged are missing one key point here. He had no reason to gain his residency illegitimately. And in the end he received it through the normal channels. What does that tell you? That he really is a naive person and I hate to say it, pretty stupid. Why else would someone who could get his residency through the normal channels go this route? And for all we know Douglas could have told him you are not going to qualify but don’t worry I know someone in government who can fix things for you but its going to cost you money, don’t worry this is how its done here in Cayman blah blah. And this naive guy just went along and paid and paid.
Now if he knew he was illegible for residency because of having a criminal background or whatever other reason and purposely tried to circumvent things and get his residency the illegitimate way then yes by all means throw the book at him and revoke his residency, but that clearly was not the case here.
The case here is one of a simple stupid man, period.

@9:47 – If Robb had no reason to try to obtain his residency illegally why did he go the illegal/questionable route? Why not apply through a lawyer or migration agency?

What amazes me is how someone so stupid, I’m sorry but there is no other word for it, amassed $1.9 million?

Probably through unwitting use (is there any other kind?) of the Dunning-Kruger effect; not having sufficient intelligence or awareness to second-guess himself in respect of whatever he did to make the $1.9 million.

You really contradicted yourself. After stating that he had to illegitimate intentions, you continued on and said the opposite.

I guess Robb could do well without your legal advice.

    • YP says:

Lol. It truly does appear that this guy really isn’t all that bright – however, when has that ever been allowed as a valid excuse? It hasn’t and it wouldn’t. What truly amazes me is that he was able to amass a $2 million fortune… If he had invested it judiciously, he probably could have turned that in $10 million and retired on GC without a need for status.

Because there is more to the story, but as in typical fashion all the emphasis was put on another “caymanian’s” wrong doing and a chance to address the elephant in the room will go missed.

CNS: Don’t be silly. This article was about Judith Douglas’ sentencing following her trial. It reports what was said in court.

    • Judas robbed Robb says:

@9:47 I read in one of the articles that he did not want “mere” residency but instead wanted Caymanian Status. There’s a difference between the two that’s why he was willing to pay in order to illegally obtain Caymanian Status. Now his residency should be revoked! Tough lesson but a lesson indeed.

The judge needed to give Mr. Robb in jail sentences as well. All that money he kept giving that facety ass thief and weren’t given proper reciepe with Government logo.
But that’s what happens when you tries to get things the easy way it never pays off. My mother always told me going the cheap or wrong way about accomplishing things never work out you always end up paying double. Well I tell you Mr. Robb, seems as if he paid double, double. I don’t feel bad for the idiot this should teach him and other expats that comes into our Country to go about things the right way. It’s a pity I couldn’t get my hand on some of it desperately in need of some serious funds right now.
Douglas, prison should be nothing to this ain’t the first time you been there and won’t be the last. You need to stop stealing girl, you did the crime so hear what be prepared to do the time behind bars.

  10. Douglas vs Robb says:

Both of them should be locked up in jail cause if he so deserved Caymanian Status he should went about it in the correct way about it. Wrong is wrong and I know what she did was wrong but so is Robb.

He should be arrested and charged for paying to get Status. It shows that he is not a good Citizen of these Islands. She only left him with $19 dollars in his bank account well it looks like if this idiot had more money he would still be paying her but the money came to an end is the only thing saved him.

Judith what you done is wrong and you have to learn you can’t continue living life like this cause it not your first time doing this and as it sounds you keep repeating the same BUT with that been said Robb you are just as bad as Douglas cause you were trying to obtain Cayman status and not the proper way. So a thief is a thief and because you are said to be the victim here does not mean you are innocent cause you were paying Douglas for something you that you taught you would not get on your own. So to put it in a nutshell you should be in Northward prison and Douglas in Fair Banks prison or they should let you all be side by side cause she just a tuff as you stupid. We really don’t need thieves like you here Robb point blank. As for Douglas we can deport her cause she is Caymanian but I call on our so call government to investigate people like Robb and let them leave the Cayman Islands but I guess you all want 100 Thousands people no matter the back ground so you will honor him. I guess we will honor you all too.

As he says- and apparently the evidence supports – she told him most of the money was a deposit to show his financial worth and would be refunded – your view that he thought he was paying bribes of nearly $2 million may be rather unfair. Agree it doesn’t demonstrate good judgment on his part, but sending him to jail for being gullible seems a bit harsh.

Robb should have been charged as well and had his day in court as a defendant. The fact that he came forward could have been treated as a mitigating factor in his favour but not to the extent of no charges at all. If the prosecutors did not charge him for fear of discouraging people from coming forward to expose such scams they should think again. It sends the message, if you try to corrupt the system and it does not work out for you, then you can make a complaint and the authorities will take care of you.

CNS, I see no mention of Judith Douglas assets, does she drive an expensive car, what type of home does she live in, is it all paid off, surely if she had access to all this money
her life style should have been questionable, how much funds does she have in the bank-

Something is not right with this story, why didn’t the police follow the money trail

Saw her picture on Cayman Marl Road, and she do not look like someone who had
access to all this money- or she didn’t spend it on herself

Apparently nothing was recovered because she had no assets. More than likely she didn’t save any of the money she was thieving from victim. I’d wager she did what most Caymanians do who are fiscally irresponsible and/or thieves do when they get a lump sum of money; Fly to “Myameh” (Miami) and blow the money out on various crap.

Robb, dishonesty ruined your chance to further prosper in the Cayman Islands. There’s no symphony given and I’m betting you hoped to recover some portion of this missing CI$1.9 million monies when you, broke and all, went to the police.

Desperate measures to obtain your citizenship lead to desperate measures to go to the police as you may have not had a choice otherwise. Something is lingering though, can’t shake the feeling that there’s more to the whole fiasco.

The revocation of your permanent residency status is a must as an undesirable, because of your attempt to circumvent the Legal process.

What i don’t understand is that this man was willing to illegally obtain Cayman Status, in essence con/defraud the people of the Cayman Islands of something that he did not earn. Yet he his so distraught and outraged when the tables were turned and he was the one that ended up getting conned/defrauded. Don’t get me wrong Douglas deserves to go to prison. However, I have no sympathy for Robb and wonder why he has not been charged with conspiracy to commit fraud or something similar. Deterrance should be both for the people taking bribes and doing illegal things and to those willing to pay a bribe/ monies to obtain something illegally.

Funny how the law works when someone robs the rich and gets 10years when he who btw should have also been charged for his greedy mentality thinking that he could just buy a cayman status no matter the cost, as to a convicted murderer/menace only getting 5years for his crime, smh, this system is truly broken.

On the other hand, he ought to have given Mr. Robb a year for being a naive fool. How do you hand over $2 million dollars to someone? The stupidity has to be beyond comprehension. Also paying someone to “arrange” for status, yeah, probably not the most legit.
