Men fear false sexual harassment accusations
(CNS): Two in five women in the Cayman Islands have been subjected to unwanted sexual harassment, which is higher than the global statistic of around 25%, according to local officials. And while around 10% of men report being sexually harassed, one in four fear being falsely accused more than becoming victims.
During a town hall meeting in George Town on Tuesday evening, officials from the Cayman Islands Government’s Gender Affairs Unit (GAU) presented the latest draft of the Sexual Harassment Bill 2023 and outlined what is in the legislation and what it is designed to achieve.
GAU Senior Policy Analyst Karlene Bramwell, who led the discussion, noted that sexual harassment is pervasive worldwide, including here in Cayman. The bill aims to create safe work and other institutional places, free of unwelcome behaviour of a sexual nature.
But Bramwell said the government has recognised that there is a fear the law will be misused or that some actions or comments could be misunderstood. During the consultation period, some men had expressed concerns that the law could fuel false allegations, she said, but noted that the legislation provides sanctions for vexatious, frivolous and false allegations.
The bill covers broad sections of society and requires institutions, such as employers, landlords, church leaders and people who run places of entertainment, to prevent the sexual harassment of their workers or clients.
Employers will be required to roll out a specific policy to prohibit and deal with sexual harassment and bullying. The law does not cover sexual harassment on the street, though if the victim and perpetrator are work colleagues or members of the same church, it could cover those cases.
While sexual abuse and indecent assault are crimes, sexual harassment currently falls through the legislative cracks of the Penal Code. While this legislation is expected to address some of the gaps that allow perpetrators to get away with what can often be extremely unpleasant, even frightening, behaviour for victims, there will still be cases not covered by the proposed bill.
The legislation focuses heavily on workplaces and other institutions. It includes a sample policy for employers, which is based on the civil service’s current anti-bullying and harassment policy. This was written by Lauren Knight, the deputy chief officer in the Portfolio of the Civil Service, and implemented in 2020. Knight said it was robust and outlined what is and is not acceptable workplace behaviour and the responsibility people have to prevent it.
Alexandra Bodden, a psychologist in the private sector and a member of the Business and Professional Women’s Club, which began the campaign for this legislation, pointed out that the goal is to create environments where people feel comfortable being able to reject what is inappropriate behaviour and a culture of intolerance towards those who seek to demean others.
Bodden explained that it’s not about misunderstanding jokes but about creating spaces where jokes or comments that undermine others are not acceptable. She said this legislation is just the first step in a cultural shift towards the attitude of sexual harassment, but it will begin to codify what is and is not harassment and bullying.
Bodden added that sexual harassment is a form of bullying and it can undermine the victim’s physical as well as their mental health and undermines productivity.

I am a 70+ white haired man who certainly does not want any of my sisters, daughters, granddaughters, nieces or any other women harassed. At the same time I can understand the concerns of some, as in recent years I have been cursed out several times for simply holding the door open for a woman. This has happened at the grocery store, at the Government Administration Bldg., and elsewhere. I should note that I also hold the door open for men and for children and that none of them have cursed at me for holding a door open for them. Many thank me. That is my experience of Cayman these days.
That’s the world now adays as common courtesy is seens as some sort of attack or oppression.
Well that’s odd. I invariably hold doors open for other people regardless of age and sex, and they say either thank-you or nothing. I have never, ever, been “cursed” by anyone for doing so.
My advice? Stop it with the obscene remarks while you’re opening the door.

Section 18 of this Bill, which prohibits victimization of a person making an accusation, states that it is illegal for an employer/manager/organisation to take any action against a person alleging sexual harassment without any exception. It therefore prohibits any actions being taken against a malicious accuser even if the allegation is determined by the Tribunal to be a blatant vicious lie designed to destroy the career/life of an innocent person. That is what the authors of this bill see as just.
On the other hand the Bill in its current form says nothing about victimizing innocent persons and therefore permits an employers/managers/organizations to victimize a person who a Tribunal finds to be completely innocent of the malicious allegation brought. Clearly the authors of this bill think that everyone accused of harassment ought to have their lives destroyed irrespective of whether they did anything wrong or not.
I suggest that as the majority of people subjected to malicious accusations will be men, the Bill should be renamed ‘The Misandry Implementation Bill’.
(Misandry is the term for hatred of men)
If you read the fine print, the ‘Tribunal’ that will judge allegations of harassment is borrowed from another piece of legislation. The composition of the borrowed tribunal in that other piece of legislation is 5 persons, one who has to be an attorney but none of whom are required to have any experience or qualification relating to the law relating to sexual harassment. How does that sit with the Constitutional right to a fair hearing.
This bill is crap.
Legal experts would not necessarily have to be experienced in one particular law to be in a position to interpret it, follow court judgements and to apply the facts. That only required experience as a lawyer. A litigator might be better suited but it would be a challenge to find a lawyer who made a career of sexual harassment litigation with a law that is not yet passed. Nobody has that experience and similar laws in other jurisdictions would not be identical to ours. I think you are making a mountain out of a mole hill with this argument!
Reductio ad absurdum – Following your reasoning perhaps the Central Planning Authority should be the arbiters of sexual harassment disputes, as the CPA generally has an attorney as a member.
By your dismissive reasoning regarding the legal expertise required in adjudicating quasi-judicial proceedings, the powers that be could do away with the qualification and selection processes used for the Cayman Islands Court of Appeal and the Privy Council and just appoint 1 person recently called to the Bar to chair plus a handful of lay people off the street given that all that is required is for one person out of 5 in a tribunal to have a bit of experience as a lawyer.
As I understand the Bill, the Tribunal as presently structured, will be comprised of 5 political appointees with anyone with more than 1 day call to the local Bar being qualified to lead the Tribunal. No member of the Tribunal is required to have any relevant experience regarding determining the probity of evidence or many other relevant considerations. Yet they will are expected to provide fair hearings and to decide whether or not to end people’s careers. That combination will likely give rise to a greater percentage of appeals than the Immigration Board. But then its only public funds that will be wasted.
However well intended, this bill in its current form is poorly thought through and should be withdrawn, properly researched and re-written.

Has anyone else noticed that the only ‘work place’ in which men are completely exempted from the effects of this Bill and able to harass to their hearts content may be our Parliament? That is what it says in Section 3 of the Parliamentary (Immunities, Powers and Privileges) Act. Is anyone surprised?
Its striking that nearly every comment referring to harassment takes the divisive stance of male sexually harassing female representation and nothing else. Whilst any complaints caseload will likely show that representation, surely the question has to be asked whether the presentation and perceived objective of the bill has failed. It will be interesting to see if/how the GAU gauges this and whether there’s a shift in their bidding that targets a better understanding of their broader incentive, bullying etc. or is it first things first, we’ve yet to figure out whether we’re goats or tortoises.
What is a male to female ratio among work permits holders? Does immigration try to maintain 50/50 ratio? Don’t need to be a sociologist to anticipate problems in a male dominated society.

People making comments against other people having a choice in relation to their preferred pronouns might be interested to note that according to section 3 of the draft bill, such a comment made in a public forum would likely constitute sexual harassment as it would likely offend the dignity of persons having a specific gender preference.
I don’t know why we need the type of expensive Tribunal that this bill talks about.
If a woman accuses a man of harassment she should be permitted to tie cement blocks to his hands and feet and toss him into the sea over the Cayman Trench. If he floats he is guilty and should be sent to prison for life. If he sinks for 10 minutes or more he is innocent and unlikely to cause any problem in the future.
My first reaction was to laugh at this comment but then it occurred to me that this is an excellent metaphor for exactly what this Bill proposes in terms of someone falsely accused.

Based on the comments here and in discussions about this Bill, many men feel that, as this Bill was apparently drafted without any consideration of the experience of men in our society, there is strong likelihood that they will loose their jobs, their professions, their careers for simply saying ‘Good Morning’ or for holding a door open, or for looking anywhere other than at the floor or the ceiling, should this Bill become law. That is their experience.
Or could it be that a great many men have had experience with women who are malicious or simply hate all men?

Once this bill is fully implemented, best to look only at the top of a woman’s head or floor tiles as they address you. Then exit with a simple “I bid you adieu”
It would probably be best to look at the ceiling rather than anyone’s head and to avoid saying anything as some may not know what ‘bid you adieu’ means and file a complaint assuming it is harassment.
That is an excellent suggestion that should be followed by all males, especially anyone with a management or supervisory position of any type. It would obviate a lot of potential problems particularly if combined with never looking at a female or standing/walking within 10′ of one.
Men may also be well advised to follow the same advice in church, at the gym and everywhere else where interaction may take place.

Against what standard is the measure as to what is acceptable being assessed?
Whilst jokes or comments relating to protected characteristics would be more straight forward to deal with, how is it proposed that we deal with an individual who is offended about the content of a conversation that is neither offensive nor malicious nor intended to be and in some cases not even about the offended individual, but misconstrued as being so by that individual.
In a diverse environment such as the civil service, there is bound to be some rub in cultures and understandings and allowances need to be made to create a safe environment for employees to feel confident to challenge but also for there to be some dialogue to educate so that what are minor misunderstandings are not blown out of proportion and careers ruined based on an individual being over-sensitive or narcissistic.
The tendency to escalate minor issues out of proportion without seeking to fact find and informally resolve issues just makes matters worse and creates a negative environment.

Harassment is real.
However this legislation provides that harassment is purely subjective rather than objective. There is no penalty for making, or threatening to make, a false accusation in order to gain an advantage. Falsely accusing a co-worker with whom you are competing, or with whom you may compete in the future for promotion, might just be the best way to eliminate the competition and secure that promotion.
BTW – the legislation itself is blatantly discriminatory as it only refers to and applies to people whose preferred pronouns are he, she and they. What about the rest of our population?

Ridiculous or not Section 3 of this Bill provides that gender identity and thus the individual’s right to a choice of pronoun is protected. Stating on a public forum that a comment is ‘pronoun nonsense’ will be unlawful once this bill is passed. Ponder on that.

What specific flavour of normal is expected in Cayman? If you ask 10 women here from completely different cultures and backgrounds they will all have their quite opinion on what is normal. Same goes for men from different regions and cultures. For instance I once had a Trinidadian girl whom I barely knew out of the blue plant a kiss on my face unexpectedly when I turned around. This happened in North America, I’m North American and I found this particular experience to be quite abnormal.
There is also the issue of where communication between men and women, both bodily and verbally differ. A woman who is interested in a man doesn’t necessarily give understandable signals, where men tend to be less subtle at least in Western cultures.
I think there is a bonafide fear out there that some women simply will take advantage, use this to get back at colleagues or bosses they don’t like, or simply have an axe to grind against men.

The first line to promote standards and enforce policy must fall on the line managers and immediate supervisors to educate and enforce standards.

All the complainant has to say was that from their perspective they believed they were being harassed…it is impossible to prove they believed anything else so even when the allegations are false they will never be sanctioned.
Men have strong reasons to be fearful. I think there will be far less comraderie in the office going forward and many lines of communication will shut down…especially if you are an expat male.
