Opposition motion complicates speaker’s removal

(CNS): With Hurricane Ian distracting the government and the country from the current political controversies, the deadline issued by Premier Wayne Panton to Speaker McKeeva Bush came and went Friday without any sign of the speaker’s formal resignation. As of Wednesday evening, Bush still hadn’t stepped down. But with an opposition no-confidence vote in the government on the order paper for next week’s parliamentary meeting, the challenge of ousting Bush from office has been complicated, Panton has implied, as the opposition seeks to take political advantage of the situation.

Although Bush had told the premier in messages earlier this month that he would step aside, since then he appears to have re-thought his voluntary departure. Bush has also denied in social media postings that he has done anything wrong in the face of sexual harassment allegations that triggered the latest scandal surrounding the veteran West Bay MP.

Responding to CNS questions about the failure of Bush to resign in line with his request and the next steps he would take, Premier Wayne Panton indicated that the opposition motion had created new difficulties.

“As you know, I issued the speaker with a letter strongly suggesting that he resign the Office of Speaker on or before September 23rd,” Panton told CNS. “After dealing with the threat of Hurricane Ian, unfortunately, we now have other matters to deal with. After I called for the speaker’s resignation, the PPM filed a motion of no-confidence in my leadership and in the entire PACT government.

“It is interesting to note that in respect of issues surrounding the speaker in early 2021, the PPM’s response was to seek the dissolution of Parliament, and now on this occasion, they are seeking to dissolve the government. Against that backdrop, one is left to question their priorities,” he added.

While it’s not clear what either Panton or Bush plan to do now, the speaker’s position clearly remains untenable. But the reality is that he currently retains the seat and control of the parliamentary order paper, though not issues that directly impact him.

Former North Side MP Ezzard Miller, who is well known for his keen understanding and accurate interpretation of local Standing Orders as well as Erskine May, the UK’s parliamentary guide book that is known as the Bible of parliamentary procedure, said Bush cannot preside over his own demise. Miller said it must be dealt with by the deputy speaker. But he also said that the opposition’s motion for a vote of no-confidence, which Bush has reportedly accepted, would not remove Bush from office.

“Even if the motion were to succeed in removing the premier, it won’t bring the speaker down,” he told CNS, noting that Bush was voted into post by a majority of MPs and it would take 13 of them to vote to bring him down. Miller said that whether the government wins or loses, Bush would remain in office until there is a vote of no confidence in him or an election is called.

At this point, the opposition motion looks likely to fail as it will need 13 votes to succeed. But the question has been raised over why the PPM opted to file a no-confidence vote in government rather than in Bush. Miller also pointed out that there are problems with the opposition’s motion as they are calling for a no-confidence vote in the whole government but the rules call for a no-confidence vote in the premier.

In any event, to win a no-confidence vote the opposition needs 13 votes and have only six members, so they would need ministers as well as government back-benchers to vote in favour of it. Such a vote would be tantamount to an admission of failure on their part and a poor start for the Progressives if they plan to poach any of Panton’s front-bench team to form a new government.

CNS understands that the opposition had been planning a no-confidence vote in the government for several weeks. The PPM leader recently said they were aware of concerns raised by some PACT members which had led them to believe that the government was vulnerable. However, we have asked the opposition leader why he chose to file that motion now rather than filing a no-confidence motion against the speaker, since the PPM have publicly stated that they also believe the speaker should resign, and we are awaiting a response.

In the meantime, Miller said the opposition may have overplayed their hand. He said Panton has a number of options, such as calling for a special meeting or an early election, which may not go very well for the opposition, he said.

The former PPM-led government chose to call an early election last year because then premier Alden McLaughlin was reluctant to deal with the speaker directly. Since Governor Martyn Roper allowed that early election to happen, Miller said, the political precedent has been set because of the reluctance of those in power to deal with Bush.

Miller said none of this was good for the country or the legislators. “At some point the dignity and reputation of the parliament has to take priority over political machinations,” Miller told CNS.

At the moment, unless things change in the coming week, Bush remains in office and could still preside over the next session of parliament, when government hopes to steer through a busy legislative agenda. Some of the bills the government is hoping to pass include a historic overhaul of the Poor Relief Law, an amendment to the Traffic Act to reduce the amount of alcohol that drivers can consume before getting behind the wheel, and a change to the Education Act to mandate anti-bullying policies in schools.

But it is now expected to deal with the PPM motion. Despite the differing opinions among the PACT members, the coalition of independents is expected to hold in the face of the no-confidence vote. It will, of course, give 18 of the 19 elected members the opportunity to either condemn or praise the current government, but it is likely that the government will need to call a separate session of parliament for a no-confidence vote on the speaker if Bush continues to force the issue and cling on to the speaker’s chair.

    We can debate Parliamentary failures for a month, but what about judicial failures when someone under probationary release on criminal charges can get handsy and get away with it? Why after taking witness, video and victim statements are there no new charges being brought along with breach notices? This is the type of dark force inference that is most worrying and destabilising to stakeholders who witness what isn’t happening on that front.

Get yourselves together and deal with the important issues of this country and it’s people! Stop fighting amongst each other like a bunch of kids and stand up against Mac’s wrong doings.       Tricia, I agree with you entirely. I am extremely disappointed with the Opposition’s motion, they need to withdraw it and allow Mr Panton to deal with the critical issue of introducing a no confidence vote on the Speaker as soon as possible.The vast majority of our of our voters want him out and expect our elected representatives to abide by their wishes. This will be the first step towards restoring confidence in our leaders.

    Anyone see the irony in our near collective being aghast at the bad man McKeeva as if this country has led a to-date stunningly beyond reproach existence holding ourselves to the highest morals, ethics and integrity since foundation!

    FFS, the last 30 years alone has witnessed more corruption, enabled more tax avoidance and morally questionable tax evasion that we’ll ever know. Most of us don’t even understand what is really happening here as an offshore tax ‘efficient’ center.

    Bad man Mac owns this place because he’s been around the block and knows everyone’s secrets. he is untouchable, which should make you question just how bad it really is..

Attributing credit that he is somehow the criminal mastermind behind foreign tax code loopholes, is profoundly generous even for an eel like him. He was involved in First Cayman Bank and threatened to sue Offshore Alert to muzzle reporting on Gulf Union and Qatari owner Sheikh Jabor bin Mohammed al-Thani. All he has cared about is that the FS industry prints reliable money that successive governments have fully spent, without accountability, and exponents more in the form of long term debt.       Panton and the PACT can only remove the Big Mac if his members will vote with him to remove him. I understand that there is no unity among them so he probably do not have the votes. He managed to get a number of the newly elected to switch from negotiations with the PPM to his side. That is the reason why PPM didn’t have a majority. I guess he had more shine than the PPM. It was never about the country. Now he does not have their support . As the saying goes he is now between a rock and a hard place. Another saying is karma can be a friend or bitch.

          The brain trust of Alden, Roy, Kenny, Joey, Jay and Jon-Jon want to wait till the results of the investigation are in, criminal charge filed and a trial verdict is in, like they are waiting for Miss Cayman’s trial results. That should all happen in say, fifteen years from now.

      The Premier’s governmental continuity appears to hinge on retaining Mr. Bush; if he actively removes Bush, does he still have a government?

      I think this is what the Opposition is trying to exploit, however that ill-timed and childish motion is, imo, detrimental to the country, and extremely self-serving to the PPM. I would have held them in higher favour had they worked with PACT toward the common good of us all and helped to remove the Speaker from office.

      As it is now, PPM has just removed any shred of trust I might’ve held for them.

      Did we have to follow the national division of the U.S.?? Could we not have actually worked together toward the common good of the country?

    It’s funny how Premier Panton and his Govt members all deflect by only highlighting the PPM, their words/motions and what they did previously. When all but 1 member in the PACT Govt publicly spoke out, marched and criticised the PPM Govt previously now have nothing to say about their own support for Big Mac.

    PACT is just as guilty for entertaining Mac because they had a crash course in politics. However, Premier Panton made some very firm comments at the start of their run and every so cleverly uses his mouthpieces to bully and stray away from the topic and his Govt says and does nothing.

    SPARE ME. Don’t miss the bigger picture with the headlines and snippets they (PACT) provide to you.

      @11:41am..Did you read the article?..The reason the Premier is pointing out the PPM and their vindictive ways is simply because instead of using this opportunity to remove Mac they inserted themselves into the issue and are trying to disrupt and bring down the Government.

      My take on this is that this is all about Mac and Alden trying to survive and keep their power one more time. When the opposition in the previous Government decided to bring a motion of no confidence against the Speaker, his friend Alden in an attempt to save them both. Alden thought that calling a snap election that he would look good and the people would think he was getting rid of Mac and he would save himself from losing his Government but that backfired on him. Now that PACT has told Mac to go Alden sees another opportunity to take control of the Government again by teaming up with MAC and having him ram through this “vote of confidence” motion in hopes that Mac will come over and help him form the Government and Mac once again saves face and keeps his seat an likely remain as speaker.

      These two, MacKeeva and Alden, really need to put out to pasture and away from politics forever. Neither is any better and both spend their time hitting bar to bar to the point now where some of the bars even have special seats for them…you can’t make this shit up!

        In my opinion, this Govt definitely needs to be disrupted and dismantled they are 3 bulls in 1 pen trying to “run” the Govt. Most Ministers are simply doing their “own thing” because nothing can ever be agreed upon.

        What has this Govt done of any REAL value since taking over? NOTHING…why? Because they are not running as one machine and worse given the lack of experience of the majority of them. The headlines that they shoot out to the media have absolutely no weight on the scale of doing things that benefit all Caymanians and residents of this country, not select special interest groups because of some sort of guilty conscience penance.

        If you understood Politics you would understand why the PPM did what they did by calling the early election. The members of the PACT Govt were all out in their numbers protesting #isshesupported, called out the PPM for not taking action against the Speaker and even campaigned against this sort of behaviour by the Speaker and said they would not work with him…only to understand that they would have to in order to form the Govt. So they all swallowed their vomit once. Fast forward to the incident, the Code of Conduct which was highlighted due to the incident that took place at Coral Beach is NOWHERE to be found, drafted or submitted to the House for Members to sign. Now Premier Panton and his Govt are all very silent about what they are doing to handle this recent incident. Instead, he and Jay Ebanks have a p!ss!ng match in the headlines to state ‘who’ got the Speaker to resign. (A resignation letter we have YET to see signed and delivered by the way).

        They should send the motion in – yes. Put the pressure on the PACT govt – yes. Maybe it’ll get them to actually DO something for this Country – heck it may even get them to work together to save their seats.

PPM’s action against PACT will probably NOT bring an end to PACT — but it will serve to delay McKeeva’s ouster. Too bad the people of Cayman don’t have the good sense to vote out the whole PPM gang, seeing as they clearly don’t have the people’s interest at heart. (And if you’re a woman (or even a man), how on earth can you EVER vote for McKeeva???)

        Wayne thought his dream job would be a walk in the park- he lost control from the beginning. Also I do not believe that the PPM’s motion is about the Speaker – Wayne is using it as an excuse. If he wanted to he could have brought the motion two days after he suggested to the Speaker to resign. I do not believe he had any intention to oust him.

        The comment refers to the piecemeal voting system allowing candidates to run in whatever district they choose and enable parties to strategically run candidates in different districts, but voters can only vote for the least worst candidates who runs in their district.

        The country needs a countrywide national one person/ one vote, to allow voters to choose the collective best of those who put themselves forward for election for the country, not the least worst per district.

In any democratic country, once the election is over each side takes up their side of the aisle and accepts their level of power until the election. Alden like Trump, would cause war and do anything to overthrow the government because he had to sit on the other side for 4 years.

      In fairness, Ezzard headed PAC for over a decade – for sure, diligently reading all of the reports, but, by blowing his whistle rarely, helped institutionalize a culture of misappropriation and waste, that the Caymanian people now suffer under. He had a front row seat to all of it, including the warehouses of sticky finger transactions and soft-dollar power trades we never read about.

        To Anonymous 9:30am: The Constitution does not give the PAC teeth to do anything beyond requesting an audit from the Auditor General who then reports findings to the public at large, something that Miller decried on several occasions. You might forget that the PAC wanted to prosecute someone at the Airport Authority as well as the HSA; in both instances, they did not get the required Parliament support to do so. So you cannot blame Miller.

    I remember too well McLaughlin’s devious conduct with regards to the cruise ship pier/dock referendum. For a man that is a lawyer, he did not act in good faith or equitably. And if he had had his way with building a pier/dock, this country would now be in the midst of a financial maelstrom. This behaviour of calling a no-confidence motion in the government, rather than solely addressing getting rid of Bush, is the PPM once again demonstrating it is misguided and driven by self-interest.

      The dock was going to pay for itself. I cannot fathom how people still didn’t listen to what was said? THE CRUISE LINES not the people of the Cayman Islands. If they didn’t come for 5 years they can only collect what they bring to these shores BY PASSENGERS. No risk, it was the deal of the century. At the end of the day WE still need a cargo dock. But we will have to pay for that one ourselves.

The opposition motion has no consequence if the PACT government is as strong as they say they are. It will only get 6 votes…right ? So why is Panton so afraid of it ?       We do not need the FCO to dissolve the house- the constitution has the remedy. Please do not mention direct rule – have you been listening to the BBC? Their new prime minister has only been in a couple of weeks and her first motion drove the pound so low that they are dreading that the country will go in recession. Meanwhile their secretary of the exchequer is running from the press. Direct rule will not be the panacea you think it is.

    Fail to understand why a vote of no confidence in the Speaker can’t still be filed by any of the Government or Opposition? Complicated or not, one of Roy or Wayne still has the ability to bring it forward, which will force it to take place at some point. Better than either posturing around apparently being afraid to actually call a vote to topple the real power in Parliament…
    PACT, PPM, cowards the lot of them.

      You appear to have a drastic misunderstanding as to what power the premier has. He cannot remove the speaker of his own accord, he does not have the power nor the government mechanism to do so. This is because the speaker is supposed to be an impartial position not beholden to the party in power at any time. Hence why the premier nor any other member of parliament can unilaterally remove him.

        Right, BUT the premier and ANY OTHER member can move a motion of no confidence in the Speaker, but they are all afraid. I guess he has big secrets on all of them, so they don’t want to poke the bear too hard. what the Premier should have done in the first place, instead of writing Mac a “strong letter” suggesting that he resign, was to Move a motion of no confidence in him. But all 19 of them are playing games, acting stupid and being cowards, because they know the majority of the country doesn’t know/understand the Constitution.

    Give others a chance to do the right thing. And I never thought I would say it, but it’s time to allow those born elsewhere who have since been granted status, a chance to serve their community in a new government.
