Gunmen’s appeals fail on all counts

(CNS): Malik Mothen (38) failed to have his conviction for a gang-related shooting overturned Tuesday, and both he and co-defendant Kashwayne Hewitt (22) failed to have their sentences cut in relation to the crime, which happened outside a West Bay Road nightclub in February 2017. The Cayman Islands Court of Appeal agreed to hear Mothen’s challenge to his conviction for GBH with intent based on claims that the judge’s summing up for the jury was inadequate. But the court denied the appeal, as they found that the judge had given very careful and detailed instructions to the jury.

The panel of judges declined to hear the appeals regarding the sentences of 13 years given to Mothen and 12 to Hewitt, as they found that neither jail term was excessive given the circumstances of the case, in which one of the victims was lucky not to have been killed.

Mothen, from West Bay, and Hewitt, a Jamaican national, received the sentences for attacking and shooting Daniel Bennett and Carlney Campbell in a feud-fuelled altercation.

    Appealing with lawyers paid for by the State! In such an appeal where the cost is paid for by government and it fails, their jail term should be increased. Ridiculous!

    Want to do the crime now do the time. Too bad we have to pay for your meals and free medical etc. while your prison. You should do hard labor. Karma boy.

    Why aren’t these criminals from elsewhere, not deported immediately back to their countries, upon conviction? We don’t need to be feeding and taking care of them for years on end. It will certainly free up a lot of space in the prison.

      Don’t you mean GOOOOD? They’re damn lucky the sentences, which IMHO were way too lenient, weren’t increased.
