Crystal Barnes being arrested for a traffic offence

(CNS): The police have confirmed that they are conducting an internal inquiry after video footage was posted on social media Thursday, in connection with an arrest on an outstanding warrant. The heavily pregnant woman posted the video on social media and it was re-posted numerous times after she accused officers of using a heavy-handed approach and causing her injury — all over traffic fines for which, she said, she had already confirmed a payment scheme with the courts.

One of dozens of warrants that police have been following up on, mostly for outstanding fines and unpaid traffic tickets, on this occasion it appears that the agreement the woman made with the court was not conveyed to officers, who went to her home to arrest her.

The video shows the woman attempting to finish dressing and put on her shoes as the male officers  entered her bedroom and tried to pull her out. She became increasingly upset with the officers and began swearing as they told her she was under arrest and she could not get herself ready, even though she is in an advanced stage of pregnancy.

An RCIPS spokesperson said that officers had viewed the footage and referred the matter to the Professional Standards Unit “for an investigation into the full circumstances of the arrest”.

The news comes following a police meeting in West Bay Wednesday evening where Commissioner Derek Byrne said he was committed to ensuring his officers behaved with respect and courtesy and that he “wanted the shoulder number” of all officers who behaved in an ignorant, arrogant or impertinent manner.

The PSU is now solely an internal body of inquiry, as all complaints from the public about the police are being handled by the new independent police complaints authority that forms part of the new Office of the Ombudsman.

And they picked me up from RUM POINT! The officer even gave me time to get my shoes, handbag, brush up my hair and make a call… All I did way comply #justsaying

    It’s not about the shoes. It’s about her saying “we’re doing this my way” and playing the pregnancy card etc. Bet that works with everyone else but it should not and did not work with arresting officers. If she was really worried about her baby she would have said “yes sir” and gone with them with no fuss.

    The reality is that these police officers were extremely patient, to the point of incompetence. If you are there to arrest someone you can give the person a minute to slip on shoes if he or she seems reasonable and safe, but that’s it. Then you cuff the person, walk them to the car, and transport. Cops and the public get hurt when a situation is handled as unprofessionally as this. Do they not train the police on how to conduct an arrest?

    He too bright, he should have looked further into it before handling the woman like this. Because I know she told him about the previous visits by other police.

    This is what happens when court staff don’t do their work and the police too damn lazy to ensure what the woman was telling him.

    Needless to say the police should have investigated the warrant from the first time they went to her house because it was lifted (January 5) even before the first visit to her home. (January 15)

    The incident occurred on the third visit about the same warrant which was not lifted.

    My god what are the court staff doing in the day time????

    They need to buckle down to make sure they don’t get another law suit against the government because of their “clerical errors”!

Go all out on them for not doing their job the right way! Especially the government system for arresting you with out a warrant and the system for not having the information updated and there for you to clear it up. ( which was lifted from more than two weeks prior to the incident) Apparently the government system is outdated and she went to pay this $50 from the 15 January but it was not there, and again on the day she was arrested but it was not there. Who’s to blame but the system, they came to your residence to harass you on a warrant that was recalled and I don’t blame you for cursing at all!!!!! She has to be damn pissed the hell off. XXXXXX If I know I was right after trying to explain then initially agreed to go with them and they put they hands on me of course I’m going to turn my video on. I’m not going to take no side but this really is beyond measure. Really…. be a man and help her put on her shoes… as you can see they let her afterwards and went in the room to get her lotion lol (sorry but if she wants her lotion let her) she had to sit on the floor to put them on! I couldn’t put my shoes on at that stage in pregnancy my husband had to.!!!(As indicated in the second video) I definitely will personally contact this woman and help her pay her lawyer fees too!!!! F**k all the negative people on here. Why unna don’t go comment on her page so she know who unna is. Bunch of hypocrites probably sympathize with her when they see her in public tho! Bullshit!

    A group of strong, strapping men physically mandhandling an 8-month pregnant woman.

    Try as many of you have, nothing about this case justified the risks of what transpired – including the actions of the woman.

    These are not the kind of police I want my taxes to employ.

    As a man there have been many moments where I’ve realized it is best to just walk away and address a conflict another day and time – and I am not a trained officer of the law.
    This was one such moment. There was absolutely no urgency about the situation – at the end of the day, ego won the battle and the (CNS) masses appear to support this reality.

    Amazingly she could pay the fine – all of it- after this incident and not before! If all those on here berating the police experience a crime and call for help and police do not show I hope you call this woman for help. We are accepting bad behaviour and lawlessness and still expect crime free peaceful society. We reap what we sow. You break the law you pay the fine. Putting lotion on your skin is not a priority. Slip your feet in your slippers does not take forever pregnant or not. She just wanted to prove she had more power than the police. Y didn’t she simply produce her extension papers?

    No tact! He should also be aware, that when dealing with females, you most certainly need a female officer present and “handling” the individual.

    We should all know by now that the most “upstanding” of citizens do not usually have any encounters with the police. Why do we then, judge the lesser folks according to those standards?

    These types of people deal with police officers regularly, for obvious reasons. The police must learn to take care and lead by example. After-all, they are in positions in society to do just that!

    Had this woman killed her own child and/or murdered someone in society I could understand the frustration of the officers and their desire to remove her immediately and put her in a cell. But, traffic infraction?

    We have it all backwards here. Why don’t we see this type of aggression from police officers toward young males in society who reek havoc on us all????

If she complied to any of the numerous requests this would not have happened. Also, if it was so bad why was she able to keep her phone perfectly on herself the entire time?

    Punishment is greater than the crime committed. If people could pay online, the problem would be solved. If there were designated parking spots for people to pay fines, majority would do it without delay.
    I remember reading in a New resident magazine : it goes like that “ it is nice to be pregnant in the Cayman Islands. Everyone treats you exceptionally well.”

    Let me give you a little hint, when you’re under arrest you have NO rights to extra time getting ready.
    And as far as her being pregnant and these officers showing compassion, they did just that. She was resisting arrest: Did you see them slam her on the floor before handcuffing her? No. But they sure as hell aren’t going to roll over and let her have her way.
    Don’t like it, don’t break the law.
    Disagree, be thankful the police don’t shoot first and ask questions later.
    Clearly we see the behavioral traits of her next of kin.

      Couldn’t agree more. The cops were there for close to an hour, waiting for her to ‘get ready’. She was never going to find her shoes, people. She was trying to play the female and pregnant card, thinking foolishly that they would just leave. They are POLICE, sister, and you are being ARRESTED.     The courts should be held accountable for this incident to some degree. Issuance of warrants against persons who have paid fines or made arrangements have been taking place for many years. This is not the first incident where someone had had to ‘suffer’ at the hands of law enforcement due to wrongful issued warrants. It has happened too many times over the years, even as staff have changed, to be chalked down to ‘clerical’ error. Some years ago there was a discussion of whether the police should followup to ensure warrants were legitimate just before going out to enforce; the conclusion was that courts’ job is to issue, police to enforce, not call to the courts to confirm first. Who knows, as the argument is debatable, as police could be held just as liable if anything happens. As in this case. We do not know exactly WHAT transpired prior to the beginning of this recording. Heck if I were pregnant I would be cussing too. Pregnancy us no joke, with mothers and babies being hospitalized or dying simply due to stress and duress, heart rates increasing, blood pressures rising, panic and anxiety attacks, etc. Premature labor. Then what? I do believe officers should be trained to handle such situations a bit more delicately. I do not know this young lady personally but I have ‘heard’ her name around. Evidently ‘known’ in police ‘circles’. I feel this could have had a slight ‘influence’ on how she was handled. Police generally approach known persons a bit less delicately (if we can say any reasonable percentage of Cayman’s police are “delicate” in these times). As the article states, she is in advanced stage of her pregnancy. She didn’t threaten nor attacked the officers. She could claim fear and safety for her and her unborn child. It is Cayman. Plus Officers have the authority to use their discretion.
    People are going to start suing government departments and individuals. There won’t be any more hush hush or bullying. Human rights were introduced for the benefits of prisoners and immigrants, but human rights pertain to ALL…even pregnant women.
    Any men on here commenting especially anonymously…if she were YOUR unborn child’s mother…?

    No sympathy for her – I been driving for well over 30 years and only once got a speeding ticket in the US. Given that the traffic laws here are extremely relaxed, it is a wonder that she got a traffic ticket to begin with………..so chances are she is not driving within the traffic regulations on a regular basis. Also, I was taught to respect authorities, especially the police, but these people watch too much TV and think that behaving like brats means they are tough.

      How about people doing the right thing and avoiding all this drama…

      1. Be an upstanding citizen and do not get parking tickets in the first place.
      2. If you do get parking tickets, do the right thing and PAY them.

      Stop blaming the court system, court staff, police and everyone else except who could have avoided this initially….the woman in the video.

      But since she didn’t do either of the above, when the police came to her house, they are lawfully there to make an arrest. They cannot negotiate or discuss anything, their only job is to carry out the arrest warrant.

      She should have as quickly as possible grabbed a pair of slippers and some clothes and go willing.

      When the police are there to arrest you, it is not their duty to wait until YOU decide that you are ready to leave.

      Seems like she had some underlying motive as she turned on her phone video.

      I have no sympathy for this girl as she was foul mouth to begin with and resisting arrest. RCIPS yes have a few not so pleasant officers BUT they are doing a job and this is what we as citizens expect of them. Simple. We must respect authority.     This is how Jamaicans deal with Jamaicans in Jamaica – drag them out, dead or alive; they have the power and they abuse it. Unfortunately, they have now been given the power to arrest Caymanians and treat them just as they would a Jamaican back in Jamaica (Jamaican criminals here get treated differently – they don’t get arrested).

    Nothing will change that this was handled was wrong. Unprofessional is not the word for this policeman’s performance. Fire his ass and get a replacement; there are Caymanians in line for the jobs and if there aren’t, well I remember when we recruited Bajans who were a whole lot more civil than what we are seeing here.

    I’m sorry but this was just wrong and anyone who says that they being pregnant, emotional and being wronged would react in the most positive manner…well…i’ll leave the rest of my thoughts to myself.

If you’re 8 months pregnant, you put the safety of your child first. In one of the articles she said she was not only needing her shoes but putting on her lotion?         Did you watch the video with the sound on? She ignored EVERY request/command the police gave to her!

        And she was only ‘in distress’ because she put herself in that situation by being so belligerent, nasty and hostile.

        If a cop asks you to do something… swearing, arguing and refusing is not the answer.

        She’s the problem. Period.

        Sorry actually it isnt a wrongful arrest, if you are speeding and get a ticket and fail to pay it the fact that you have failed to pay it it is on that basis that the ticket becomes a warrant for your arrest. That is the seem if you are summoned to appear before the court and fail to do so. Once you have been placed under arrest you no longer have any liberty. Not saying that your have no human rights you simply dnt have the luxury to want to lotion or anything else. I wasnt there when the encounter happened however based on the video she was resisting arrest and conducting herself in a disorderly fashion. Just my 2 cents

      This girl is a problem….and been a problem to society. Her own family is heard in the video telling stupid to calm down and just do what the officers say. Not even her family condoned her behavior. So all you that are stupid enough to watch this video and agree with this girl, you are just as bad and ghetto as she is.

      Newsflash, if you all believe that her “family” stood their and watch her get “abused” by police and yet told HER to behave herself then you all are just as DUMB as she is!

    You can clearly hear the Police explaining the procedure to her when the video starts “your mother is coming to pay and by the time we get to town you will be released” in a calm tone. It is Ms Barnes that initiates aggressive behaviour by cursing and being non-compliant with the police by justifying that she’s pregnant. Even if you are pregnant or not, it’s obvious a warrant was made because the fines went unpaid and unfortunately that wasn’t relayed to the officers in time who were just doing their job. If u made an agreement with the court, you still have to follow the correct process and procedures! I’m sure the officers would not have held on to her arm like that if she wasn’t displaying such hostility towards them.

    I hope no one points fingers at the Police for simply executing their duties.

    Uniformed police officers now entering private homes to physically remove and arrest pregnant women over a civil / fiduciary matters?

    Sorry, this is not a good look for the RCIPS and I doubt any excuse will be acceptable.

    The fact that the internal body which will review the matter appears to mirror that of the UK police’s IPCC (think / research Jean Charles de Menezes) does not instil much confidence of there being a suitable outcome.

    The RCIPS leadership should take swift, transparent, and meaningful action to address this matter asap.
    We should not underestimate the rumblings and friction that exists between the local community and the RCIPS as a collective.

    I hope mother and unborn child are doing fine despite the stressful ordeal.

    *Honestly, what were these grown men thinking? Are they not fathers? Do they not have wives, sisters, and mothers? At the very least, could a female officer not be called to the scene?

    Putting aside the possibility of bad training, shouldn’t the human empathy toward a pregnant woman take over one’s decisions and actions at a time like this?

    Personally, although admittedly devoid of all the facts, I am uncomfortable with these types of individuals in the role of police officers.
    Unless we are missing a major and damning piece of the puzzle, every officer personally involved with this incident should be dismissed – and disciplinary action taken against the superiors responsible for training as well.

    ** There is another video of the incident on social media wherein we see the officers in what appears to be her bedroom, standing over her in a menacing manner as she is on the floor applying lotion and completing her “getting ready”.

    I doubt we would see similar action by these same officers against women / citizens of a different background and or in a wealthier neighbourhood.

    Apparently, this was all over a $50.00 fine.

    We are on a slippery slope.

If you can solve so much issues in this little rock, maybe your country needs you to be its saviour. The police officer gave her the proper explanation and was carrying out his duty. There was no need for her foul mouth and dramatic disrespect.

      This is part of the problem….you want to pick and choose which part of the law the RCIPS needs to uphold. All laws need to be enforced, regardless.

    She made the number one mistake when it comes to interacting with law enforcement, it might not be in the laws but everyone knows being disrespectful to a police officer (whether they deserve it or not) is the quickest way to find yourself in handcuffs in the back of a police car and all they have to say is “disorderly conduct” or “resisting arrest”

    I am not siding with the officer or with the woman but if you remain civil, even if you are being treated unfairly you’ll likely save yourself a load of potential trouble with the law because if it is your word against an officers with no other sources or evidence you will not be believed

    Nice language…what a bright future. As much as the RCIPS is bashed every day, the officer clearly stated “you are under arrest” and there is no “getting ready” time, he is doing what is expected from him by law and from our community. Drama…Drama…Those situations can be avoided if you simply take care of your things, show respect for the law and be responsible (Great habit especially being a soon parent).

      That’s the problem because no one here wants to hear that. It is quite simple, but not when you’re preaching to the simplest of minds. Rule #1 listen to the police and follow instructions (whether you judge them to be right or wrong), Rule #2 don’t break rule #1.

    Maybe I am old school, but even before I contemplate RCIP using a “heavy hand” or not,( which I didn’t see), I listen to the cussing used at authority. My parents would’ve cuffed me if I ever used such language and then to direct it to an authority. Never! She should’ve just followed instructions of RCIP and went and settled the matter politely….especially as a pregnant woman. She caused a lot of drama for herself and for her baby when she could’ve politely and MATURELY dealt with the situation. Is this how she will deal with things in front of her child? Might need some coping strategies…instead of swearing and acting childish.

        Doesn’t matter if you don’t have the money- you don’t throw a tantrum and swear at officers. You, especially at 25 yrs. old, don’t get pregnant if you don’t have any money . You also handle your responsibilities in a calm, respectful manner, especially dealing with RCIP or authority figures.
        This is a woman having a child in less than one month. smh
