260lbs ganja costs dealer two years jail

(CNS): Eduardo Swaby Gutierrez received a two-year jail term on Thursday after some 260lbs of ganja was found in his laundry room. The massive drug haul was discovered at Swaby’s house in Boatswain Bay when police officers from the RCIPS Drugs Task Force raided Gutierrez’ home on Monday, 5 September. But in what was one of the court’s quickest ever disposals of a serious drug seizure, Gutierrez pleaded guilty to possession with intent to supply at the earliest opportunity and made it clear that his girlfriend, who was also arrested during the raid, knew nothing about the drugs.

Leonela Pedroza was discharged by the court after the crown withdrew the charges against her following Swaby’s unequivocal admissions.

Magistrate Grace Donalds said that the appropriate sentence was three years in jail given the quantity of drugs, but she gave Swaby full credit for his exceptionally quick admission of guilt.

    Looks like the judge is sending a message re: cannabis. 270 lbs, second offense 2 years?

    People should not be criminalized for possessing small amounts for personal use. Also it should be legal for medical reasons – for serious conditions.

    Times are changing on the Rock and it nice to see that.

      Yeah. Real nice to see a habitual drug dealer get off lightly. Just plain nice.
      So far this time the police haven’t “lost” the evidence against him. When they do, that will be nice.

    Anon @ 5:44 I’m not sure if you are a lawyer , but you obviously never heard about the charge of being concerned its not the easiest to convict on but many people in cayman has gone to prison on those charges,in this case the prosecution called it a day because the maximum sentence for first offense for possession of intent to supply marijuana is 7 years, and this is not even close to the worst cases look at the cases in the past with thousands of pounds and some of those guys walked

    In the early 1980’s a young friend of mine at just 20 years old, was sentenced to two years for possession of a spliff. He was never the same after that and is a shell of himself today.

    At that time our stupid legislators had passed a law for a 2 year mandatory sentence for a second conviction of possession, regardless of amount. That law was subsequently amended after it was realised that young lives were being destroyed.

    Fast forward to today and this guy received 2 years for 200+ pounds of weed!!!!!

    Even with the change in attitude towards Marijuana, this is ridiculous!

    This is not the first time that he went to jail in Cayman for drugs. He should be sent back to Cuba where he came from.

    It appears that politicians are now importing other countries rejects for local votes.

    What another joke within the Cayman Court system!!! 260lbs of illegal drugs and 2 years prison! 5-7 minimum and the girlfriend knew about it and could have told police earlier. What a joke

    How can someone live in a house with 260 lbs of weed / ganja and not know, I think that they should have been taken to the police station drug storage and opened the door and see what they would say then .

      Even if his girlfriend knew, you would still have to prove that she aided and abetted, or some form of participation in procuring the marijuana. “Knowledge without participation is not a crime”! .

        Do you know what 260 lbs looks like? It’s a lot. Like filling a small van to the roof. Police could smell it OUTSIDE the home. She knew and willfully abetted. They were smoking some when the cops arrived!

      Is he a status holder? Why was there not an exclusion order? Easy to say his girlfriend didn’t know about it. How could he have and dispose of 260 lbs of ganja and she wouldn’t know he had it? Come on, is she really let off the hock? If she is on a permit, it should not be renewed. This is the only way we are going to clean this country of undesirables. What most of us don’t understand is, that criminality is the way of life in most of those countries, from where they came from.
