Sex-offender who molested child dodges serious jail time
(CNS): A local man, who cannot be named because of his connections to the little girl he sexually abused for five years, starting when she was just seven years old, will serve only a few months behind bars, even though on Tuesday he was given a sentence of more than three years. The case against the 43-year-old man took years to come to trial. Because of this and because he was on a restrictive, electronically-monitored curfew as he awaited his day in court, much of that time has been credited as time served against his prison sentence.
The man was arrested in 2020. After various issues led to long delays in the case coming to court, he was found guilty in 2023 of seven counts of gross indecency and sexual assault. The case was heard in a judge-alone trial, presided over by the late Justice Michael Wood, who died after the trial and before the guilty man was sentenced, leading to even more delays in concluding the case.
As Justice Marlene Carter, who took over the case following the death of the trial judge, delivered the sentence ruling, she said the delays in the case were “egregious” and not the fault of the defendant, who had worn a monitor with varying degrees of restriction on his movement for four years, including periods, such as the school holidays and weekends, when he was under home confinement for 24 hours a day.
Restrictive curfews such as this often count as the equivalent of partial days in prison, giving the court the latitude to consider them as time served.
As a result, the original sentence of three years and nine months, already discounted for the very long delays, dropped to just one year and three months once the man’s time on the monitor under curfew was factored in.
However, given the length of the original sentence before the discount, which is still used to calculate the man’s time in prison before he is eligible for parole, it will be just a few months before the offender is able to apply for early release.
Carter noted that a social inquiry report found that the man continued to maintain his innocence, and he had told social workers that he had forgiven the victim for making what he claimed were false accusations.
No victim impact report was given to the court because it was determined that it would be too traumatic for the girl to undergo another interview about the abuse.

Ah – so the other judges have to go because they are Jamaican, and Marlene because of her conduct in this case? No – it doesn’t make it better. Try substituting “black” or “Jewish” or “female” for Jamaican, and it may begin to dawn on you that attributing negative characteristics to a group of people based on a common identifying factor rather than actual actions, might just be wrong. I really don’t care what anyone think of my comment and I don’t know who the person is charged for this crime. As a little island like this, for such an horrendous act, against such an innocent person, is truly a crime that cannot be tolerated!! What are we saying as a judicial system? Remember in a place like California, shoplifting is tolerated if the value of the stolen item is below a certain threshold and store owners get arrested for chasing after shoplifters. People operating in Cayman – including those working as Magistrates and Judges – have drank the liberal juice and we get nonsense ruling in this particular case. Wrongdoing is tolerated in Cayman and everyone deserves a second chance with a slap on wrist and a good dose of Counselling ordered to make sickos better! Not many votes for politicians in these matters so it is ignored by them.
I’m not surprised by this decision but I’m saddened by it.
If we want to minimize wrongdoing in Cayman, then we need tougher laws with minimum periods of incarceration – we can’t rely on tough decisions from courts

The criminal’s acts against an innocent child were “egregious” beyond measure. Your opinion makes the monster into a victim. The evil perpetrator having to wear a monitor with varying degrees of restriction on his movement for four years–including periods, such as the school holidays and weekends when he was under home confinement for 24 hours a day–all served to keep the public safe and prevented the animal from preying on more children. We now know he well deserved the restrictions and they absolutely should not be counted as punishment and he should not be given credit for that time period.
Here in the Cayman Islands, the Director of Public Prosecutions (DPP) has the authority to refer cases to the Court of Appeal for review if a sentence appears unduly lenient. This is outlined in Section 30(1) of the Court of Appeal Act (2011 Revision), which states:
“If it appears to the Director of Public Prosecutions that the sentencing of a person has been unduly lenient, he may, with the leave of the Court, refer the case to it to review the sentencing of that person.”
This provision empowers the DPP to seek a review of sentences that are clearly insufficient, ensuring that they appropriately reflect the severity of the offense.
The DPP should direct an appeal against the sentence.
Sexual abuse and child molestation is permitted in the Cayman Islands.

Sexual Assault includes rape, learn your facts and stop your attempts to water down what this disgusting a-hole man did unless you’re prob a pedo too.
Love it when people come out with “learn your facts” and then don’t bother learning them themselves. “Sexual assault” is not a defined offence in the Penal Code. Rape is (s127), but requires penetration, as the OP says. Gross indecency with a child under 16 doesn’t (s134). Now the maximum sentence for rape is life, and gross indecency 12 years. So rather than watering down what the violator did, OP is pointing out a pretty relevant issue in terms of the sentencing. Doesnt explain why the judge only handed down 3 years and 9 months with a 12 year maximum, but may well explain why he is not facing life in prison, which most people would expect for a crime of this nature.

Caymans judicial system is nothing short of pathetic and disgusting when it comes to these kind of crimes. He should be getting a 20 year minimum sentence for this. Crimes against children should result in capital punishment as far as I am concerned. If this was my child he would be at the bottom of the trench already.
