Education minister urges disruption to gay wedding

(CNS) UPDATED WITH RESPONSE FROM DAY: Education Minister Juliana O’Connor-Connolly has urged the public to attend, uninvited, to what will be the first ever same-sex marriage in the Cayman Islands in order to object to it. In her contribution to a debate in the Legislative Assembly on Wednesday, the member for Cayman Brac East implied that gay people are evil. But the minister also read out details of the marriage notice for the two women, Chantelle Day and Vickie Bodden, who successfully petitioned the court for their right to marry.

She told people they could object to the union ahead of the wedding, but if they missed that “window of opportunity”, they should go to the ceremony and object then.

In response to the minister, Day told CNS, “The marriage law has been modified with immediate effect by the chief justice and same-sex marriage is now legal. The minister of education’s call for objections to our marriage in writing/in person demonstrates a blatant disregard for the rule of law, and raises concerns of abuse of her position of power as a leader in our community. It also shows a complete disregard to the call from the premier urging everyone to act respectfully.”

In the LA on Wednesday, O’Connor-Connolly accused Chief Justice Anthony Smellie, who legalised same-sex marriage from the bench last Friday, of “judicial tyranny”, and did not hold back on expressing the religious beliefs fuelling her objections to the decision.

The debate was triggered by a private member’s motion tabled by Arden McLean (East End) and seconded by Anthony Eden (Savannah). It was moved up the order paper by the premier after he delivered a statement outlining the government’s intention to appeal the decision of the chief justice in the Day and Bodden same-sex marriage case.

The education minister labelled last Friday, the day the chief justice delivered his decision in the case that was heard in the Grand Court in February, as “Black Friday” and claimed it was another signal of the impending end of days, as she derided those who would dismiss her comments as religious bigotry.

But like many of the members who spoke in the debate about the judgment that delivered marriage equality for the Cayman Islands last week, she focused her debate on the opinion that the judge overstepped his powers when he changed the law. She suggested he had put the democracy here at “grave risk” and said the judgment was based on “foreign disciplines” coming from people who have an agenda.

“I just can’t find the words to adequately describe the tsunami — spiritual, social and otherwise — that has been going through this country since last Friday,” O’Connor-Connolly said. But she said that the legislature had started the “resurrection” after Black Friday with this motion and debate and the government’s decision to appeal.

Government is also seeking a stay to prevent the law from taking effect, but it is not clear that even if the attorney general was able to successfully receive such a stay from the Court of Appeal, it would be in time to prevent Chantelle Day and Vickie Bodden from marrying next week, as planned, or stall any other ceremonies where a same-sex couple has already received a licence.

It is not yet known how many local same-sex couples have so far applied to the General Registry for licences to marry, but CNS understands that a number were planning to do so in light of the chief justice’s ruling.

It is also understood that a number of Caymanians who have married overseas are now seeking to have their expatriate spouses listed as dependents, since those marriages have also been legitimised and recognised in law locally as a result of the CJ’s ruling, which currently still stands.

    If the Politicians and the Churches want to spend money on a lost cause for an appeal, they should have to pay for it out of their own pockets, not using taxpayer $$’s.

    It won’t be that much, as the Court of Appeal will uphold the Judgement and I doubt the Privy Council will even entertain it.

      Depends….the ever-patient and classy ladies hadn’t sought damages in the Judicial Review phase, but that patience might have limits. I probably wouldn’t be so noble this time around. I’d be counter-suing the Gov’s office, FCO, and each Cabinet minister individually on this continued BS.

    You do not show up unbidden at someone’s wedding so that Marvin Busybodden can “object” to the marriage.

    You timely file them with the registrar, sworn and in writing, and subject to a forty dollar fine if they are frivolous:

    25.
    (1) Any person may notify his objection to an intended marriage by giving notice of objection to the Civil Registrar or Marriage Officer publishing the notice of banns.

    (2) A Civil Registrar or Marriage Officer shall disregard all objections to an intended marriage not appearing on the face of the notice, unless-
    (a) they are stated prior to the issuing of the certificate of publication:
    (b) they are stated in writing by the person making the same; and
    (c) the person making the same appears personally to lodge the same with the Civil Registrar or Marriage Officer, and in his presence makes and subscribes a declaration as nearly as may be in the form set forth in Schedule H, which the Civil Registrar or Marriage Officer shall endorse on the written statement of objection.

    (3) With regard to objections timely and duly made, the following shall apply-
    (a) Where the objection does not set forth a legal impediment to a marriage between the parties intending to solemnise marriage, or a refusal of consent on the part of any person whose consent is required to such marriage, the Civil Registrar or Marriage Officer shall suspend the issue of his certificate pending decision upon the objection, and shall consider the objection and make such enquiry thereabout as he sees fit, and himself decide thereupon.
    (b) Where the objection sets forth a legal impediment to a marriage between the parties, or a refusal of consent on the part of any person whose consent is required to such marriage, the Civil Registrar or Marriage Officer shall refer the matter to a Judge of the Grand Court (who shall decide upon the same in as summary a way and as expeditiously as the circumstances of the case will permit), and shall suspend the issue of his certificate until he receives a certified copy of the Judge’s decision to the effect that the parties are not, in respect of the said objection, disqualified from contracting such marriage, or where the objection is in the nature of a refusal of consent that such refusal is unreasonable and ought not to interfere with such marriage.

    (4) If it appears to the Judge that the objection, in case of an objection to a marriage, was frivolous and vexatious, he may condemn the party making it to pay, in addition to costs and all civil damages to which he may be liable, a fine not exceeding forty dollars, to be enforced in the same way as a judgement of the Grand Court.

        In the UK – objections (at any wedding) can only be for a legal reason. Same sex marriage is legal now – objections cannot be vexatious and per the Cayman Marriage Law (http://www.gov.ky/portal/pls/portal/docs/1/11526403.PDF)

    The Minister of Education (ironically) has demonstrated that rock bottom actually has a basement… just when I thought things couldn’t go any lower, an elected official has not only decided to tarnish a peaceful act of love between two consenting adults (one born caymanian one of caymanian decent) but is inciting people to disregard the law that these person have a right to marry, created a situation which could potentially become violent and promoted a culture of hatred and intolerance.

    It perplexes me that this is where the Minister’s is currently focusing her passion and not on developing policies which would boost public schools performance from weak to excellent and reducing youth delinquency.

    I appreciate the strong feelings on such a controversial matter, but respectfulness and intelligent discourse must be maintained, and that tone should be set by Law Makers.

      As Christians, wouldn’t the best example to follow be Jesus’ example? Marriage is a divine institution but the social rights attached to it under the marriage law are civil constructs, aren’t they? What about a civil partnership law? What about giving civil rights without having to get into the divine aspect of marriage?

    I obviously have my stance regarding the definition of marriage in the Cayman Islands and believe Civil Partnerships are the best way forward from this stand-off, however, I would NEVER support a proposal to interfere or disrupt the ceremony of a same-sex couple – or any other, for that matter.

        How is the Minister reminding or in most cases informing the general public of their legal right to object to a wedding inciting violence or riots???? It is in the law of the Cayman Islands. She did not say to go and riot or commit violent acts at the proposed wedding….she said if you wish you can go and object. Voicing your objections is a legal tool and process. Persons talking about riots and violence same to be those who would forcefully and violently attempt to prevent a citizen from voicing their objection. The law says nothing about objectors being invited to the wedding. Finally an objection is not a violent act.

        CNS you deserve the upmost respect! I know you guys get a lot of crap for reporting the news. I sincerely appreciate your efforts and I hope you continue to make a difference. This situation is such a shame and could have been avoided if any of our lawmakers knew what pro-active meant or had any sort of concern for their people. It is interesting that most of Cayman knows the gay MLA’s, the gay Pastors, and so on, and yet we have to listen to this type of garbage and witness the current state of affairs. Also amazing how the god-fearing among us hint at this societal tsunami, when in actual fact there isn’t, they’re simply in echo chambers, the vast majority of the nation couldn’t care less and are thankful fellow humans are being treated with dignity and respect they’d expect for themselves. If people wish to continue believing that any of the Testaments or any of the 000’s of gods or 00’s of religions (take your pick) are factual, that’s fine, but keep it to yourselves and try to bring some logic and reason into it, maybe even some compassion…the gay brigade are not going to harm your children, the dump, lack of education, cost of living, and global warming are ….

      Why don’t you go and object to the persons who are fornicating and committing adultery as well? Better yet, go to the bars on Friday and Saturday night and protest all the people leaving you have sinned by drinking in excess, at least then you might actually save a life… can’t do that at a gay wedding.. i’m just saying LOL

      It’s quite remarkable how you feel the need to object to a union that has nothing to do with you. How would you like someone to come to your house and point out everything that they think is wrong with how you live your life? Better yet a bunch of protesters just hanging out by your house doing that? Wouldn’t be cool if it were happening to you now would it? I fail to see how people call themselves Christians but yet they act in the most un-Christian like way. I call them one day Christians because during the week they spout of their beliefs to everyone and judge everyone all the while committing every sin that they can and come Sunday they ask for forgiveness. Like a free pass or something. Times change and so do laws otherwise we would be living with laws that still allow for black people to be slaves. Take a good look at your life and how you are living it and stop judging other people just because they don’t have the same belief system as you.
