Scott sues Cayman Brac vlogger for defamation

(CNS): Dan Scott, the leader of the Cayman Islands National Party and candidate for Cayman Brac East, has filed a suit against Brac resident and local vlogger Kerry Tibbetts-Whittaker over at least seven social media posts and vlogs about him that the would-be premier claims were defamatory. In an affidavit, Scott outlined allegations that Tibbetts-Whittaker made about him in late January and early February, accusing him of giving out home furnishings, including appliances, and assisting households with hurricane supplies as part of a vote-buying effort that the former accountant had conducted for over twelve months.

Tibbetts-Whittaker also accused Scott of bribing the chief justice in 2015 over a legal case also involving her. Scott was one of a number of people involved in that lawsuit to prevent the release of the employment details of permit holders at several law and financial firms.

Tibbetts-Whittaker also accused Scott of planning to misappropriate public funds if he was elected to office and became premier, among other accusations about Scott acting in bad faith in their previous legal run-ins.

CNS understands that the court gave an interim directive last week that some of the posts should be taken down. The court found that, despite having a right to engage in political debate, Tibbetts-Whittaker had made unsubstantiated allegations about judicial corruption, which had crossed a legal line. It is understood that Tibbetts-Whittaker agreed to remove the vlogs that Scott argued could damage his bid for election.

However, the case is scheduled to return to the courts on Friday for a substantive hearing.

Scott contends in his affidavit that none of the claims made by Tibbetts-Whittaker were true and could never be substantiated because they are all false. The CINP leader did, however, confirm that he has assisted vulnerable people in Cayman Brac with hurricane preparation and repairs, as he had people living on Grand Cayman over multiple seasons. He said that none of these efforts were “politically motivated”.

Scott claimed that Tibbetts-Whittaker’s accusations were a “smear campaign” as a result of her grudge against him for the 2015 proceedings. These related to the injunction against her to prevent the publication of the work permit salary spreadsheets that were the subject of an erroneous FOI release.

The would-be premier said that he was “a man of integrity with a strong moral compass”, and unless she was prevented from doing so, Tibbetts-Whittaker would continue to try to damage his reputation. He maintained that those who know him would dismiss the allegations “as nonsense”, but said that with people who don’t, the wide dissemination of the videos could seriously damage his campaign.

Scott argued that because Tibbetts-Whittaker had continued with her false allegations even after he had delivered a letter-before-action and because she had claimed to have documents that do not exist, which could make her social media audience believe there is something in the false allegations, the only solution is injunctive relief.

    Dan ONLY wants to be Premier. He has publicly stated he wants the Premiership.

    He also knows that he will never win a seat in the house in Grand Cayman so he figures Cayman Brac East is the easiest because of his daddy.

    So knowing what he wants and why he is running there its easy to figure the rest out.

    Cayman Brackers are not stupid. They KNOW that if he gets in he will forget Caymam Brac East even exists. The Brackers will get NOTHING from him.

    He currently has some very questionable men (who have been convicted and accused of dishonest crimes) doing keg work for him, fixing roofs, plumbing, giving plywood ect……. He does not do these things himself, he too smart for that, he gets questionable people to do the “Vote Buying”. This way he has deniability…. Everybody in the Brac already knows this…..

    So what do this tell you about him????

    For those dreamers who believe Dan and Wayne’s party could join up – do some research. Those two went to court a few years back (when Wayne was a Minister) over fees owing to the accounting firms (they needed more than the millions they were already making) and Wayne lost the case, which ended up costing all of us millions. Two big egos that need to be fed constantly. Both have more money than they could ever spend – yet they are desperate for power.

    Dan is not cut out for politics! Living his best life in multimillion dollar mansion – with his 7 car air conditioned garage filled with expensive cars, his 60 ft boat, and piles of $$ in the bank. He has it all, except power. He isn’t used to people standing up to him. When you are the boss, no-one can stand up to you…. if they want to keep their job.
    His idea of campaigning is to drive the car while the minions talk to people.
    Power is a hell of a thing that some will do anything for – vote wisely Cayman.

    Publishing salary data would be a clear breach of data protection laws, so it’s a no-brainer that she was stopped from publishing it. The rest is so trivial in today’s society and the law suits remind me of the days when Big Mac was suing everybody and their Auntie a few years ago, and I worry about them wasting the public purse in the same way. Some of Dan’s party are dangerous double-edged swords who might talk the talk but don’t walk the walk. He should toe the party line and join André IMO. We could be getting somewhere towards having a really solid political choice to vote for if he and Alric joined TCCP.

      Totally disagree..a union of educated people like Dan and Andre is the only hope we have to protect us from the dangers of suffering the consequences of a government of Mac Juju Saunders Kenneth Dumdum who want to turn us into Jamaica.

    For those referring to her as ‘crazy’ and a ‘nutjob’. This is someone who has needed medical help for her mental state for many years. I would just tend to ignore her, but her rantings unfortunately get far more attention than they deserve.

      The people reading or hearing the slander do not know the woman is a nut job. All they know is they’re hearing/being told highly defamatory content, which many may choose to believe as true.

    Seems to me the court is more concerned about the judicial corruption allegations rather than the right of Tibbetts to say what she thinks about Dan’s campaign.

    The same lady who posted that the CI government paid people from a neighboring island to do away with her? Am on the fence, because people like her and Sandra C pander to a demographic segment of our society whose analytic skills are very low or non-existent. That is unsettling, because there is no reasoning with such people; they function on emotion, not facts.

    This lady, CMR and the recent comments/posts about the ‘rift rafts’ and that tesla guy (both himself and people commenting about the Caymanian guy) – which for the purposes of this comment i have no opinion on – show truly how deeply toxic a lot of people are here. Caymanians and foreigners/expats alike.

    It is very unfortunate to see how divided and hateful people are here.

      I don’t know about joining them, but I hope the TCCP and the CINP publicly confirm that they will work together to form a government should neither party gain a majority. We need for the PPM and the last vestiges of the UPM and the UDP to be out of the ruling government forever.
