Crown seeks ban and jail for Hill

(CNS): Crown prosecutor Darlene Oko pressed a judge to ban Sandra Hill, the owner of Cayman Marl Road, from the internet and to lock her up for bullying local businessman, Matthew Leslie, on a social media podcast. In a sentence hearing Thursday, following Hill’s conviction in August for misusing an ICT network, Oko argued that the offence was so bad the court should issue an order restricting Hill from broadcasting online and impose jail time.

Oko painted a picture of a Hill as a defiant and disobedient person who had demonstrated an egregious pattern of conduct toward Leslie and had shown no remorse, despite the conviction. The only way to change her behaviour was to send her to prison and restrict her ability to broadcast, sending a deterrent message not just to the broader community but to Hill directly.

Defending herself and making submissions on her own behalf without an attorney, Hill argued that the crown’s position fundamentally misrepresented the case. The issues relating to Leslie in the podcast and the allegations against him were not some specific, targetted vendetta against him personally but part of a broader goal raising issues of public interest that were not being addressed.

She said there was nothing unique about what Leslie had charged was harassment, as many other public figures have found themselves the subject of Marl Road podcasts and been called out for their behaviour. She also noted that previous articles about Leslie whch did not involve the sexual predator allegations were part of legitimate and official complaints about him and his business dealings and therefore the subject of legitimate news articles.

Hill claimed that the crown had also been quick to take everything Leslie had said as gospel regarding the accusations that she had continued to post stories about him in defiance of the court, without checking. Hill gave examples where it was clear the claims were unfounded but prosecutors had taken what he said at face value.

As Hill painted a picture for the judge of what Cayman Marl Road was, she pointed out that the sources and content are not official but that was normal in the modern media landscape. She said CMR had contributed to the change in local media and that even the Compass, which she said the prosecutor had held up as an example of good media, was now publishing podcasts and utilizing social media much more.

While she said she had learned things through this experience and she would do things differently were she to do it again, she admitted being passionate about what she did and the subjects of the podcast. Hill stood by her concerns that this case was about trying to control content and potential future publication.

Hill handed in around 60 character witnesses, and the judge also allowed her to call live witnesses. Local boxing hero, Charles Whittaker and MPs (formerly MLAs) Chris Saunders (BTW) and Kenneth Bryan (GTC), himself a former journalist, gave evidence as to Hill’s character and the importance of her website and the work she does.

All three men said Hill’s site was an important part of the community as she was willing to tackle taboo subjects that to date have not been addressed in the media. They said that she gave a voice to Caymanians and was willing to tackle the issues that concerned them.

The MPs also raised concerns about criminalising Hill for what to many looked like a civil case. The prosecutor asked them if she had called either of them a sexual predator or a paedophile and what they would have done. They both said they would have sued but not sought to criminalise a reporter.

Saunders went much further and made it clear that he believed justice was not being served, given that the content of the podcast, as far as he was concerned, was well-founded and that one of his own relatives had been a victim of solicitation by Leslie.

Both Saunders and Whittaker submitted that it appeared that the court had prosecuted the wrong person.

Following a full day of submissions, Justice Roger Chapple, who is presiding in the case, said he would need time to consider the sentence and bailed Hill to appear on 10 December, when he would deliver his ruling.

    Crown got involved because they really care about law and order and justice in Cayman and fairness and equality for all and we can trust them to do right always and never waver when it comes to our rights. We should never wonder that our hero’s in law enforcement and the judiciary branch will always act with out prejudice or malice towards our people and will never forsake us or abandon us in hour of need against criminal and unsavory hoards of criminals and child molesters that invade our lands and borders.We can always count on them to safeguard our children and keep them protected. And prayeth justice be done if you believe this then yes we should closed down the CMR website and jail this woman and when she is gone and we disagree with CNS we should do the same. This issue unfortunately is bigger that the principals that are involved it’s about the the truth in some lies our opinions and how we express thoughts and where and who we express them to and language we use to do this.The most important aspects of this is our freedoms we enjoy to do this. Our freedom fortunately is more important than some peoples good ideas especially our government who’s influence and power always acts in its very own corrupt interests. In short enjoy your freedoms Cayman and do not let others take control of them and you by laws they create for their own convenience or benefit.

Those out there using her, whining and going about our current government can’t and will not do any better. It’s like a job interview where you say all the right things and when it comes down to it you can’t perform and blame expats for taking all your jobs. I am Caymanian, worked hard and live well and it makes me so sick to see how these wannabes are trying to corrupt the rest with their promises of a better life if they were the ones in power. Most of them have a chip on their shoulder because no one will promote them up the ranks for the sole reason of thinking they deserve it. Being caymanian is not a qualification. It is a special right and if used wisely can bring so much more prosperity. How about creating and using platforms that spread good messages. But that would take time and hard work and her followers are mostly uneducated and willfully unemployed voters that will happily collect their welfare checks while they continue to be a burden the rest of society.

      Why all the fear mongering about silencing people. If this was the case then all media would be shutdown a long time ago. This sounds like one of the political hopefuls using her platforms, that support politically motivated use of computers and technology to cause disruption and fear in society, to misguide the general public. Her hope is that we fear and revere her. There are many that do. So many people could correct her but fear that she will make something up about them and their businesses. So many that feel ‘wronged’ that proclaim that that will go to cmr of they don’t get their way because they know she won’t think twice before posting anything remotely salacious. Look at the businesses that she promotes. They stay in her graces as “insurance” so they’ll be spared. If there was any relevance to lies she spews then investigations would be launched and determinations made based on that which never lead to anything but destroyed reputations and longterm mental health issues. Her motto is guilty until proven innocent. Most civilized societies rely on the opposite and law enforcement to protect them.

    I am no fan of Matthew Leslie though he has done more good for Cayman than Sandra ever has. But we need to break a few things down. Matthew is part of that group that whether right or wrong they are right. He has influence and is a backed by some very powerful people. Sandra went up against that and this is the outcome. But then Sandra does not help herself. She lies, she defames, she hurts many good people. So at the end of the day she gets no sympathy for me. But yes Sandra has influence also but does not compare in no way.

    But CHRIS SAUNDERS AND KENNETH the 2 MP’s that stood up for her? I won’t say much on Kenneth because his electorate base include many of our poor who look to people like him and Sandra to nag and complain as their voice so that was a smart move. But Chris? Political suicide if you ask me but then again XXXX. Elections is coming up. I will be the first to bet that both him and Kenneth with be advertising with her and on paid interviews. They need her. Chris is looking at being a 1 term politician and if the right candidate runs against him you can kiss his seat goodbye. So end of the day they were not there for her. They were there for themselves and really should be ashamed for defending her like that.

    At the very least she needs a suspended probationary sentence and a total ban from social media . No doubt one of her sheep would then take over the running of the scandal sites out there though.

    There are so many cases out there begging to be prosecuted, cases involving real crimes, real victims, some committed by really bad people; cases with far greater merit than this one… Yet, in typical fashion, the CI Legal Department once again finds itself chasing its own tail in nonsensical matters, wasting invaluable resources and time on low lying fruit; in this case, no fruit at all.

    What seems to be more disturbing in this particular case, is that here again we find the Legal Department appearing to use its powers in an effort to square scores, to prosecute someone who they clearly do NOT like, someone who they clearly want to make an example of, and someone who up to more recently has made a LAUGHING STOCK of them. And if there’s an organization out there which does not like to be made fun of, a body that does not like to have their asses handed to them over again by a mere (albeit qualified) amateur, it’s the rather pompous CI Legal Department; XXXX

    Big bad Legal Department couldn’t convict little Sandra on trumped up computer, doggy charges et al, so now they have a go at her for other matters in yet another, among many, truly pathetic displays of abuse of power… V for Vendetta has little on these guys. As for Mr. Leslie receiving any justice, if justice is indeed owed, there is the civil court for that.

I’m against abuse of power by authorities, which is proven in Sandra’s case (how many times did they have a go at her??). In England they recently jailed an 83 year old man with hearing issues for playing his music too loudly. He died. Pretty disgusting; they let rapists go, but jail an 83 year old.

    Anyone here saying this should be handled civilly should ask themselves why Sandra just can’t be civil. Why should those who are wrongly and almost always wrongly accused not have laws against harassment on their side. She lacks decency and decorum and she is uncivil. She will never behave in a way that threatens our way of life. Maybe she went too far, or was wrong, and can pay a fine/be sued for slander, and issue a retraction, and apology, like any other media company learning the editorial boundaries. We are way past that here. This has already advanced several magnitudes beyond, into the worrisome totalitarian direction, where whistleblowers and free speech are answered with criminal sentences and UNHR violations. She spouts off about people breaking curfew but yet she is filming herself walking around her neighborhood as if it’s ok. Then when someone calls her out she acts all offended. As if she didn’t know what she was doing is wrong. She calls out the realtor who was posting flyers saying that she shouldn’t be advertising that way but yet she does it everyday on her site. Whether getting paid for it or for her own selfish needs. She calls out people for hoarding but then you see her buying case after case of Clorox wipes saying that she’s getting prepared. Then when people call her out on that she claims it was for her and a friend. What’s also worse is she basically uses her site to harass people and say all unsubstantiated things against them and then when that person realizes what’s going on and gets upset she then expects them to come and talk about it on her so called “podcast” to defend themselves from fantastical claims she made up herself. It’s completely ridiculous and it’s also defamation of character. She is a menace to society and needs to be stopped. She acts all high and mighty but yet doesn’t seem to understand that what she does is not called journalism it’s called trash talk and rumors and she runs with it and to hell with anyone she offends. It’s the typical don’t do this but if I do it then it’s ok. Like seriously? She needs to take some responsibility and stop targeting people all in the name of so called journalism. Most journalists have some sort of integrity but with any of her reports I don’t see a shred of decency or integrity. After seeing all these things on her site I have no use for it anymore. It would compare her site to something like Fox News. Which is known for telling outright lies to the general public.

    Explain to me please, why the Crown is involved at all. This seems to be a purely civil matter between Hill and Leslie. I’m not really a fan of Hill’s, however I think her website serves a useful function. Even if it didn’t, if she has crossed the line in libelous/slanderous territory, I don’t think the Crown should have taken up the cause. Jail time? What?

    People seem to not understand the charge that has been levelled against Ms. Hill. The Crown did not charge her with making false statements. What she has been charged and convicted of is using an ICT network to harass someone. Imagine for a moment that you have an ex who has been abusive towards you. He/she keeps texting and calling you. You change your number. The same thing continues. You can’t sleep in peace because of the harassing emails etc. Maybe you took some pics or shared secrets with that person and that person then threatens to use that information unless you take him back. The charge would not be assault etc. The charge would be using an ICT network to harass and many of you would welcome the fact that this person has been charged with an offence.

    If Ms. Hill and others have evidence that Mr. Leslie had committed the offence for which he was being maligned then provide it to the police or encourage the person to make a report and see it through to the bitter end. I am no fan of Matthew Leslie but frankly what Ms. Hill has done could have been done to any of us.

    I don’t think she should be banned from the internet, but if she wishes to continue to make a case that she is a journalist then she has to do better than she is doing now.

    We live in a democratic society, citizens have a clear right not to be harassed, threatened, or seriously abuse by another citizen.

    Sandra could’ve been a successful blogger, had she always fact-checked, gave both sides of a story, and not block or delete Facebook comments that don’t support her views. She’s is certainly not a responsible one.

        The right only arises by way of necessity, not convenience. A way of necessity can only exist where the alleged implied grantee of the easement has no other means of reaching his land. Having an alternate way will not itself give rise to a way of necessity.

        In particular, when other means of access to two main roads exist for the individuals on their adjoining 2.50 acres of properties, without the need of crossing on/over 4 Parcels in which 3 of them object…

          What our neighbors and the public need to realize is, that it’s our land, not crown land, every square inch of it inclusive of the private road and we’re not SELLING.

          The biggest issue with our neighbors is that they think they’re elite and above the law and it’s being put slowly to an end.

          That cycle of own satisfaction is over, it’s time to realize that other people have rights and exist. This is a civil society and everyone has a right to freedom to be regardless of where they come from.

          It’s the responsibility of our justice system to maintain law and order and address violations. Those two things exist simultaneously. If we’re attacked unprovoked, we have a right to defend ourselves.

          We refuse to willingly give up our personal freedom by simply being a faceless body in the crowd. It’s a right that we all have and is such a shame not to fully exercise it. Because even if I’m standing alone, I’ll know for a fact that it was my choice.

          It’s time to wake up from that nightmare they all insist to be in. There is no such thing as “blocked road access” to their home, there are two real road accesses on their property that are clearly visible on the main road with gates and locks that belong to them. Wake up and use them, all of you know that those accesses are real but prefer to pretend to be suffering to the world.

          The only material thing that can be slightly damaged if you use your land for access would be the grass, but for God’s sake, you insist to use our land and are putting our 3 young children at risk.

          Don’t they get it, the road was not meant for continuous use. Who the heck lays a road bisecting someone’s land? Roads are primarily built along boundaries.

          Don’t get me started, because I don’t mind paying ten (10) times after the fact planning permission fee. I’ll go build the great wall of china around our property and I dare anyone to come and stop us. That goes for you too Sandra Hill…

          AS SUCH, WE WILL CONTINUE TO UTILIZE ALL OUR POWERS TO STOP OUR NEIGHBORS FROM ABUSING/CROSSING OUR LAND.

    Sandra is no journalist, her spelling, grammar, and everything else in her writings are evidence of that. Even the name of her site “Marl Road” implies what every Caymanian knows as spreading gossip.

    Whatever story she writes, and Lord knows I have neither the time nor inclination to follow her, and whether it is motivated by misguided reason or malicious intent is debatable, but we all know the saying “where there is smoke there is fire”.

    I cannot think of one single person in Cayman of upstanding character, of whom Sandra may write something that the wider public would have doubts about their character. Truth is the only thing that stands the test of time, although sometimes history will make us wait quite a while for it.

    If Sandra is imprisoned for what she said about Matthew, then CNS, Compass, and every radio station in Cayman should quiver in fear of what may happen to them in the future if they dare to speak truth to a politician.

Daily people are berated by her team.. the name calling is atrocious and her technique of ‘simply putting it out there’ so that her minion can then devour people and situations in the most cruel commentary and attacks is horrid. Her ‘legal’ savvy is well used by her and her team to thread the fine line between reporting and hate and she knows know it. Those MP’s and MLA that stood up for her should be ashamed of themselves and ought to consider the day that they fall out of her good graces as the sword strikes both ways. The toughest judgements allows should be imposed so that this type of ‘clever’ hate speech is deterred by others.

    I actually listened to her podcast last week. This is a connected person who wields a lot of influence among her Caymanian movers and shakers.
    She actually stated that the reason why the government has not issued a statement decrying McKeeva Bush’s brutal assault on the female bartender is because there are known drunk woman/wife beaters who would be ridiculed for being hypocritical.
    She knows a lot.
    Believe me, the crown are not planning to do anything to her. This is just a game to these people.
    She does not seem concerned anyway. She was pretty jovial while mentioning it.

    This is just one more example of how the justice system here in Cayman allows frivolous cases to tie up the limited court facilities and staff. As in most free countries, individuals in Cayman have an opportunity to seek redress through civil proceedings, not through criminal proceedings.

    Shame on the judicial system for allowing this case to be tried in criminal court. God Bless Sandra for taking on much that is bad on our beautiful island.

      She calls herself a responsible journalist. So responsible that she will plaster the name of a victim who dies tragically before their family can be notified jus so she can claim the title of “First to bring you news”.     I am reluctant to see anyone deprived of their right to free speech but keep in mind it could at any time be any one of us she puts up on that page and smears its a very dangerous game she is playing

    If she tomorrow decided to accuse any one of us of something heinous hundreds of people here would just go along with it and the only recourse would be dragging her to court to await redress (which itself could take months or years over which she could continue to post and promote )

    Reporting without ethics and boundaries is of no service to readers and using your platform to settle personal grievances and scores is in and of itself a disservice.

      I think the issue here is that Cayman is not USED to the podcast format. Pretty much everything she has said in writing is also in the podcast – those are not harassment but the podcast is? Why? I would love to understand.
