Opposition makes direct attack on governor

Governor Martyn Roper presents Arden McLean with the Instrument of Appointment as the new leader of the opposition, 23 May 2019

(CNS): Opposition Leader Arden McLean has gone on the attack against Governor Martyn Roper, accusing Britain’s representative in the Cayman Islands of pursuing his own personal agenda with the implementation of the Civil Partnership Law. In a letter to the overseas territories minister, Baroness Sugg, and in a press release from the official opposition, McLean took aim at the governor, although he did not define what he believes Roper’s agenda is.

In addition to suggesting that the governor had been planning since February to push the law providing for same-sex unions, which was implemented on Friday, McLean said he had used “colonial heavy handedness” to give assent to the law that had been rejected by the legislature and the Cayman people.

In another five-page letter addressed to the Foreign and Commonwealth Office (which is now the Foreign, Commonwealth and Development Office), McLean covered a litany of complaints about the bill and how it became law last week. He also said the governor was “discourteous” for failing to respond to his letters.

McLean accused the UK of racism and compared Roper’s imposition of the law to the situation in Hong Kong (where China is brutally suppressing protests and arresting political activists). He said the governor had no regard for Cayman’s Constitution and that the people want him recalled, claiming that the majority of the people had lost faith in Roper.

While there is certainly a vocal conservative Christian movement opposing the legislation supporting human rights for same-sex couples, there are also many who appear to be more than happy to see equality for all. Nevertheless, a poll conducted by the opposition of just 1,000 people resulted in 90% against. (See CNS poll below.)

Whatever public sentiment is on the matter, gay rights are human rights and the public cannot vote for or against who should and who should not have rights within the Constitution.

The opposition leader is clearly aware of this and the official opposition has not at this point backed any legal action that might emerge regarding the implementation of the CP law. Instead McLean is focusing on the governor and his key role in making the bill law, although in the press release he also took the opportunity to criticise his political opponent, Premier Alden McLaughlin.

Referring to Roper, he said, “Despite his protestations that he did not want to find himself in this position and his love for the people of this country, it is alarmingly obvious that he too used this opportunity to fulfill a personal agenda.” Without explaining what he thinks that agenda is, he added, “This is borne out by his total lack of respect for the members of the legislature who voted against a bill that was flawed and rushed.”

McLean said “the lack of respect was further exacerbated” when he published Baroness Sugg’s letter to the opposition leader but did not send it on to him.

“The Governor’s actions and disregard for our Caymanian way of life, attests to the saying, ‘A man can’t serve two masters’. While the Cayman Islands public purse is paying for his salary and lifestyle, he remains very much a devoted UK public servant,” McLean stated.

CNS has contacted the opposition leader and some of his team regarding the allegation about Roper’s personal agenda and we are awaiting a response.

    100% spot on. If it’s one thing even the most oafish politicians understand, it’s getting their core base excited. And anything to do with gay rights is the local political equivalent of waving bacon in front of your dog.

    Catastrophic hurricanes, earthquakes and other unpredictable events such as food supply interruption can make Grand Cayman uninhabitable.

    I would think twice before insulting and “divorcing” Mother England. She would be able to absorb those who survive, but won’t be obligated if you go independent.

    Jamaica would probably take you once you become environmental refugees.

    There was an article on cnn.com earlier this year by Laura Smith-Spark, Nima Elbagir and Barbara Arvanitidis titled “The greatest trick racism ever pulled was convincing England it doesn’t exist”. It is a very interesting and revealing article.

    It does show how systemic racism can be a chronic problem and how change can be slow and painful when there is nobody in a position power willing &/or able to just do what is necessary to end the discrimination.

    While the use of section 81 is undesirable its recent use has ended the legal discrimination suffered by a segment of our society.

      Big part of the issue in Cayman is people like this ^^^^ thinking Cayman is independent already

      We are not an independent country, we agreed to allocate certain powers to the Governor when the constitution was approved and now we are howling that he is using them

      I don’t recall any of the members of the opposition raising a stink about consultation when they got together behind closed doors with the PPM last year to negotiate amendments to the constitution without a shred of public consultation

      Anyone who can’t see that this entire debacle is about the upcoming elections is a fool

      The Opposition cannot focus on the virus response because the PPM actually did a surprisingly decent job for the first time in decades (almost like when business interests are taken out of the picture you have no choice but to actually focus on regular people)
      The entire series of letters being sent and statements being issued is all about the next election where Arden and the other members of the Opposition will turn to bible beating and claiming that Alden wanted gay marriage all along thats all this is

    A few questions for the Opposition (and anyone who opposes the Civil Partnership Law):

    If not now, when?

    Being that Cayman is embedded in the Western world, greatly influenced by the USA, and lesser so by the Mother country and Europe, how long did you believe it was possible to avoid Same Sex Marriage/Civil Partnership becoming law in Cayman?

    Did you want to kick the can down the road for another year- make it an election issue? Or maybe 2 years? Do you really believe that you would fend this off for another generation?

    Try redirecting the opposing energy directed towards the Governor/Civil Partnership Law to urgent topics that have been repeated endlessly on CNS and impact every citizen in Cayman more directly- the Dump, enforcement of existing laws, improved education system including trades and hospitality training, environmental protection, a National building strategy etc.

        Unnamed Grandpa: I fought long and hard against the Governor to stop the Civil Partnership Law. We spent months of time and money and appealed to the highest court of the land to overturn it. We lost in the end but we put up a valiant effort

    Many of our Legislators who were raised with the very values we’re fighting for just turn their backs on the people at a time when we should be united more than ever against this attack against our way of life.

    This isn’t about gays and civil partnerships, this is about rubbing it in our faces, dividing and conquering, and imposing its will against the people of the Cayman Islands.

    I note that Arden has been MIA on the cruise berthing facility, silent on the dump, and has not said a word about the Speaker XXXX and being arrested. He has got nothing to offer on Cayman’s dreadful traffic problems or the most expensive public education system in the world delivering third-world outcomes. Nothing on the EU blacklisting. Didn’t even get out of bed when the OfReg fiasco was publicised, and who knows what his thoughts are on the current global pandemic and the shut-down of our whole tourism sector.

    Nope, Of all the issues that Cayman is facing the DPB is what finally gets him showing some signs of life. I would laugh if a wasn’t so angry with these uneducated, lazy, self-serving, bigoted dinosaurs.

    Goonish Arden lecturing Baroness Sugg on “manners maketh man” which is certainly rich. It goes on, blabbity blabbity blah, about Roper, about how a serious current judicial review finding from last year, 8 months ago was not given his required 21 day work notice – and then has the gall to point to the CI Constitution as his gilded touchstone. The very document which proved the necessity for a Domestic Partnership Law, and the very same issue which Arden voted against, purportedly backed by his democratic supporters. Forgiving for a moment that Civil and Human Rights are not subject to democratic soundings: I’d like to know exactly how many of the 694 voters in East End he claims to represent with his discount opinion, whether he bothered to poll anyone, whether there is any dataset evidence of that polling (I want to see the IP addresses and timestamps), and why he would think that any sampling of those would be anything like a representation of the 21,130 other voters in the Cayman Islands that might actually have half a brain, and be following along. If there is no evidence of polling, as I strongly suspect is the case with most of our MLAs, he should be permanently barred from politics, along with any of the rest that claim to be “representing their constituents” in the absence of empirical data.

    This is a very shortsighted move by the Opposition Leader. He needs to lean how to strategize and play the long game. There is a way to achieve many of his objectives if he would just be calm and think carefully about this situation for a minute.

    While the obstacle seems insurmountable the truth is that it is only so if you tackle it head on and in a conventional way.

    It is unfortunate that the governor has found himself in the position where he is a symbol of division and oppression for some people within our community. For some people he has been like another hurricane Ivan (hurricane Roper perhaps), bringing disaster and devastation with every turn that he makes. When you look at things from a balanced perspective the governor has been doing a reasonable job and even if we do not agree with him we should try to work towards a better Cayman for everyone.

    CNS – I voted no in your survey but only because of the way the question was framed. The use by the Governor of s.81 may indeed be legally questionable. From my perspective a direct Order in Council from the UK, legalizing gay marriage, was in fact the legally and constitutionally proper way forward. The fact that the UK failed to live up to its sovereign responsibilities in the circumstances is troubling. Having the Governor exercise power under s.81 was the easy way out.

    Now let’s see what the Privy Council has to say.

    There are many here who also oppose the Leader of the Opposition and his uneducated ability to handle this high office. Maybe the good people of East End will recall him before the Governor gets recalled.We (the Cayman Islands) have truly got to be the laughing stock of the world with some of the numb-nuts we have in the LA. A Speaker who has a alcohol, morality and ethical problem, an opposition who are inept, Ministers who are over their head (i.e. JonJon), an MLA who plays on his IPad (Whogene) when the LA is in session, and the list goes on.
