HRC expects UK to act as CMA remains defiant

(CNS): The passage of the Domestic Partnership Bill into law “should have been inevitable”, given the ruling of the Cayman Islands Court of Appeal, the Human Rights Commission has said. But as the “Legislative Assembly failed once again” to meet it obligations, “direct intervention by the United Kingdom now appears likely”, the HRC said in a statement. Meanwhile, the Cayman Ministers Association has confirmed that it will never support equality for same-sex couples.

As the members of the HRC quietly watched the situation unfold with “deep regret” that the country’s politicians failed to provide the necessary rights to all of its citizens, the association of local Christian leaders has dominated the debate over the last few weeks and remained defiant in its position.

In its position paper to the government on the Domestic Partnership Bill, the Cayman Ministers Association continued to deny the idea that same-sex couples should be afforded any rights, as they suggested that the call for marriage equality was about desires, not rights.

“The current scenario representing a seismic shift in western morality has resulted in legislators seemingly accepting the default position that a desire… must be catered to and reframed as a right,” the CMA wrote in a position paper.

Despite the fact that Cayman is a party to the European Convention on Human Rights and has its own Bill of Rights, which was voted into law by the Cayman people and confers the right to a family life to everyone, without exception, the HRC has not sought to correct the CMA.

While the church may not accept that same sex-couples have rights, the legal position is that they do and as a result the government continues to break the law by not offering a mechanism to convey those rights.

The CMA has played a significant part in this ongoing problem and was instrumental in the demise of the bill that would have rectified the legal breach. The church leaders have also made it clear they will not support any effort by government to meet its legal obligations.

“Our position has always been that we cannot support any legislation which goes against the teachings of scripture,” the CMA said in a press release issued this week. “While we understand the efforts to satisfy the directives of the Court of Appeals to specifically cater for same-sex unions, we cannot support this directive because it is contrary to the teachings of the Bible regarding marriage, the family and human sexuality.”

The government’s Domestic Partnership Bill was defeated in the Legislative Assembly on Wednesday by nine votes to eight. This means that legislators have defied an order from the appeal court and will lead to intervention by the United Kingdom.

The only two questions that remain now in relation to the issue is when it will happen and whether the British government will enforce the passage of the Domestic Partnership Bill or re-impose the amendments to the Marriage Law by Chief Justice Anthony Smellie last year.

Now in the case of this never ending dispute there is only one winner and that is The Crown, earthly title indeed, but history has given its existence. Yet again the colonial ethos of overlording over the peasants and slaves to the Monarchy will feel it’s mighty hand extended from afar to put the uncivilized ( figure of speech here) wannabe leaders in their place and submit them to it’s will,for their imbecilic way of thinking, because they knew , they perceived that this would be the outcome of the debate, send the fool a little further .

      Rest assured that the vision of independence is now even further away, for men and women of today who hold leadership positions in these Islands who are unable to comprehend the art of compromise have no doubt set back the dreams and aspirations to be free men and women and to charter their own destiny on a ship well equipped with all that is necessary for a good voyage; well yes it will remain a dream. Until we educate ourselves in the art of diplomacy, of war of subterfuge vital traits of our colonial OverlordS, , we will be forever talking crap in the Legislative Assembly and in the street corners, while our young ones future just slips away day by day.

    I do not agree with the assertion that the CMA has “dominated the debate”. They have stated where they stand, but social media and this forum have been full of submissions by people like myself who fully support equal rights for same-sex couples. The CMA does need to be aware of the damage they are doing to the image of the church in the eyes of many in the community, by focusing on this one issue as if it’s the last stand of the kingdom of God. However, they can’t be held responsible for the failure of the bill, as I’m sure most of those who voted for or against the bill pick and choose what CMA policies they will let influences their decisions.

Try 1 Timothy 6:1. Or Leviticus 25:44-46. The Bible is pretty clear (reiterated across several books), on Minority Rights, and consequences for Oppressors who thwart and scheme Iniquity.     If the passage of the proposed domestic partnership legislation was so important then Alden should not have released the members of his government from their collective responsibility. Additionally, if it is the intention of the UK to force same-sex marriage on the people of the Cayman Islands then the governor should not have allowed a vote on a piece of legislation where one of the possible outcomes is essentially a rejection of same-sex marriage &/or the related rights and benefits.

    It is also important to recognize that after the appeals court ruling there was a vote on a piece of legislation where a possible outcome was to effectively reject that ruling. None of that made sense.

      The doctrine of parliamentary sovereignty (imposed on us by the UK) means the judiciary cannot make/amend law – nor can the judiciary for the legislature to do so. The legislature make laws, the judiciary applies them.

      That is why there were options to object, no one has been able to assert why in every single other context the UK’s doctrine of parliamentary supremacy is upheld except this one.

      The Premier released his MLAs from collective responsibility makes it clear there was trouble within the ranks. Remember now, Alden cannot be Premier in the next election because he cannot serve 3 consecutive terms so he needs to play nice to be able to be Premier next time he can.

      Many people have lived very sinful lives and there comes a moment of realization that this is unsustainable.
      Sin makes us miserable that is for sure.
      These repentant people then spend the rest of their lives preparing to meet the Holy God that has given them salvation.
      Bullying needs to stop on both sides. Don’t bully people into religion and don’t bully people into sin.
      Jesus bullied no one. He kept His mouth shut as they nailed the only man to have lived a sinless life to a piece of wood reserved for the worst of criminals.
      The ironic thing is that when we stand before Him, we will be those criminals.

Probably, since the so called good book has been redacted and changed so many times over the centuries just to suit the Church’s doctrine of domination over other competing religions, perceived pagan cultures and lands. Fundamentalism has no place in a democracy but just like ISIS wants its own Caliphate CMA is fighting to further its own fundamentalist ideals here.
    This is not what Christianity was meant to be, it’s all inclusive and was founded upon the principle of do unto others as you would have them do to you.
    I’m not a practicing Christian, far from it, but I do agree with some of its teachings, especially how they relate to treating fellow human beings.

        There is only one specific focus group that is still actively lobbying to deprive Caymanians their civil rights while pretending that sodomy and/or homosexuality are still illegal in the Cayman Islands (they haven’t been for over 20 years).         It’s 100% anti-gay 24/7/365. To many voting Caymanians, that’s not just radical exclusion, but a couple steps beyond that, into the fanatical extremism camp.

    The CMA needs to stop worrying about what two consenting adults do and start worrying about the MANY cases of incest, child abuse, rape and domestic violence in Cayman.

    I have yet to hear one minister, preacher, pastor, or preacher speak out about those issues.

    Maybe try living by the Golden Rule, treat others as you would want to be treated.

    Could we have or does it exist elsewhere a full list of ALL the members of the CMA so that we, who believe in the separation of church and state, know who we are dealing with? One thing that came across recently from the prayers given at the beginning of each of the many many Covid press conferences we once had with the Premier and his team was that we have in Cayman, a very small jurisdiction, a truly staggering number of “preachers”, “ministers”, “reverends” “pastors” and “bishops”, many of whom seem to be associated with churches with very bizarre names. Is there a licensing or monitoring procedure to stop the type of terrible fundamentalist evangelism that has gone on for years in the US where the “ministers” appeal for money constantly?

      Most of them are about the “offerings”. This is why the charity law needs to mandate that every non-profit organisation, that wishes to retain such recognition, publish their annual accounts signed by every member of the board for that year. No real need for audited accounts. Just every board member to accept responsibility for them. Then all persons can see what each organisation is involved with.

      The Cayman Minister’s Association is a thinly-veiled participating branch of the far-right anti-gay “Caribbean CAUSE” hate group. Nearly the entire homepage of CMA is devoted expressly to anti-gay rhetoric and fallacy-based narratives. Spreading these seems to be the primary purpose of the CMA.

          It is not the means to win same sex marriage, it’s a benefit that comes along. What is not about money here?That is going to be a golden mine for many. For many years LGBTQ people were asking if they could have a gay wedding here and were turned away and left with no choice but go elsewhere. Just wait and see how some of the most prominent, vapid and intolerant homophobes are going to say ‘ let’s see what me can get’.

      I want the gays to get married so they can quickly scrap the whole marriage law.

      I say get rid of marriage entirely…

      My thoughts are that the domestic partnership law was to gain an advantage over the marriage law and that most Str8 and gay people would elect that instead.

      If I hear one more rule. Of LAw thing I’ll puke.. Equality before the law but having a different Law isn’t equal. One land, many people one law.

      Let them marry and then scrap marriage law

        People are entitled to their opinion. But what you shouldn’t do is prevent a right to a group of people because ‘you don’t like it’. A couple wanting to marry is none of your business. At. All. You don’t get to insert yourself in their lives and dictate what they can and can’t do. Can you imagine if someone came up to you and said you can’t get married because they don’t like it???

        The denial of basic fundamental rights, without any alternative to marriage being considered as an option. A statement that basic human rights departs from western civilization. A refusal to accept that persons be allowed to live and live by their creed, even though it departs from that of (some of) the church. I am not a religious person, but would love to support a gay pastor in establishing a house of worship here.

      Colours Cayman should file a pre-litigation complaint to ICANN against GoDaddy/Uniregistry for hosting a hate site caymin.ky. Frank Schilling needs to take down their site for violating ICANN and Uniregistry policies on hate speech.
