Teen jailed for 44 months over serious stabbing

(CNS): An 18-year-old man from George Town was given a sentence of three years and eight months after he admitted stabbing Tyrell Smith multiple times outside Margaritaville on Harbour Drive last summer. Lyle Alexander Samson Peart was charged with both attempted murder and GBH wounding with intent in connection with a fight in the early hours of the morning of 16 June, in which his victim sustained serious life-threatening injuries to his chest and torso.

The crown recently accepted Peart’s admissions to GBH rather than attempted murder and the judge, Justice Marlene Carter, gave him credit for his guilty plea and his young age.

Despite the seriousness of the offence, the judge found that Peart, who was gainfully employed before his arrest in two jobs and has no previous convictions, had shown significant remorse for the crime, which was not a premeditated attack but an isolated incident fuelled by his immaturity.

Given his age and intelligence, the judge said she believed he would benefit from a chance at rehabilitation. Justice Carter said it was always difficult to sentence young people, especially when they had shown potential, as was the case with Peart, as she urged the young man to seize the opportunities offered at the prison so that he would be able to start over on his release.

    On almost every occasion in cases involving life threatening sustained attacks, the justified charge of attempted murder is withdrawn by the prosecution immediately prior the court hearing.This seems to be just another ploy by the CPS to save themselves having to put all the work in to prosecute the case.

    Cayman is kind to criminals. Attempted murder and he gets 44 months. A person who at such young age is able to stab a human being multiple times has seriously disturbed mind. Many can shoot a person on an impulse, but it takes a certain mind set to be able to stab a person not once but several times. His age and “ intelligence” should be an aggravating factor, not mitigating.
