Gay couple ‘waited long enough’ to marry

(CNS): Chantelle Day and Vickie Bodden have “waited long enough” for the Cayman Islands Government to address the lack of any provision for same-sex couples to marry or enter into a civil partnership, Edward Fitzgerald QC told the court, as he made submissions on their behalf Thursday in the landmark case. He said his clients were in love and wanted to marry. He explained that the women had tried in reasonable, sincere and moderate ways to engage with government and ask for a remedy to the discrimination they faced, but nothing has happened, despite the clear need for the local authorities to address this issue.

Having engaged in a correspondence with the premier, who did not respond, and the governor’s office, which had responded but did nothing to resolve the problem, the couple attempted to obtain a marriage licence anyway in April last year. But when the General Registry refused them a licence on the grounds that they were a same-sex couple, they turned to the courts.

They applied for and were granted a judicial review of the decision by the registrar in addition to the human rights challenge. That is based on the discrimination they are facing over the marriage licence refusal because of their sexual orientation, in contravention of section 16 of the Bill of Rights, as well as the denial of their rights to a private and family life and freedom of conscience under section 9 and section 10.

As he opened the case on behalf of the two women, who have made the first direct legal challenge to the lack of marriage equality in the Cayman Islands, Fitzgerald pressed home the publicly declared position of former governor Helen Kilpatrick that for more than four years, following findings in the European Court of Human Rights, the Foreign and Commonwealth Office has been expecting that, at the very least, the authorities here would remedy this lack of provision with civil partnerships.

Kilpatrick spoke frequently and on the public record about ending the discrimination, and Fitzgerald noted that in a statement before she left, she had said the “need for legislation is now pressing to advance the rights” of the LGBTQ community.

But since then, there have been only “hollow words” and “hand wringing” but no action to address the discrimination and denial of rights the couple continue to face. The lawyer said the “crocodile tears” did nothing to help the challenges the women have as a result of the continued denial of their fundamental human rights. Now that they are living in Cayman with their daughter, whom they adopted when they lived in the UK, they have encountered several problems.

While Day is Caymanian and works here for a local law firm, her fiancée, Bodden, is British with family ties to the Bay Islands in Honduras, leaving her immigration status in question. Fitzgerald noted that they had many other challenges relating to their personal and family rights, for example the adoption of their daughter is not fully recognised and they face financial issues, such as pensions and health insurance.

Fitzgerald said that the respondent in this case, which is essentially the Cayman government, “holds all the cards” and has the means to put an end to the discrimination and denial of rights the couple are experiencing.  But he said they were arguing that section 14 of the Constitution, which sets out the freedom of single men and women to marry a member of the opposite sex, overrides everything else in the Constitution.

Fitzgerald argued it did not. He said there was simply no justification for the continued denial of his clients’ right to marry.

Setting out copious examples of settled case-law in the west regarding marriage equality and pointing out that the arc of human history was in favour of recognising same-sex relationships, he said the Constitution’s guarantee of marriage for opposite sex couples could not mean that any other kind of marriage could never, ever be recognised.

He pointed out that marriage has evolved throughout history. Once only a religious private institution, in the mid-nineteenth century it became an institution of a secular state. And marriage has adapted to a changing, democratic, free and secular world in may ways, he said, noting that at one time slaves were not permitted to marry, people of different religions could not be married, and in America it was not until 1967 that interracial marriage was permitted in some southern states.

The lawyer spoke of the enforced or arranged marriages and the mistreatment and inequities of women within the institution of marriage, all of which have changed and evolved to eliminate the discrimination. Fitzgerald said that marriage is now a secular, state-controlled institution, which means the state must deal fairly with the public wishing to enter into it and therefore has an obligation to end the discrimination faced by his clients.

He said it could not be that the guarantee that exists in the Cayman Constitution to protect the rights of men and women to marry each other could never be expanded. The senior advocate also argued that this legal case was not challenging the rights of marriage that is guaranteed in the Constitution for opposite-sex couples.

He also noted how it has been settled across the secular developed world that same-sex couples are just as capable of having stable, supportive family relationships as opposite-sex couples and that those partnerships need legal supportive recognition, he said.

In his detailed submissions, Fitzgerald pressed home that there was no justification at all for the lack of same-sex marriage or civil partnerships now, given the case-law, the findings of the European Court of Human Rights, the UK’s own legislation and its position regarding its territories. But he also argued why the women should have access to marriage rather than an equivalent same-sex civil union.

The lawyer pointed out that if an institution which is equal to marriage is created purely for same-sex couples, it perpetuates the discrimination, as it sets these couples apart as being in some way abnormal, adding a stigma to the institution as something for “biological anomalies”. He said the government’s response was going to be based largely on questions of public morality, which was “the horse which they are backing”, as he suggested it was based on the idea that the state should discourage homosexuality, but this has no justification as it is no longer a crime to engage in such relationships.

The government has not explained how the marriage of a same-sex couple poses such a threat to public morality and the lawyer argued the state has an obligation to treat all people equally so there is no justification for this continued denial of rights. Fitzgerald pressed the point that his clients were being treated differently by a democratic state purely because of their sexual orientation. He told the court that the case was about human dignity and the women’s right to be treated fairly, without discrimination, and to be able to enjoy a private family life as a married couple because they both believed in the institution.

The case, which is being heard by Chief Justice Anthony Smellie, continues Friday.

A right should never be determined by a person’s sexual condition. It is a claimed conditioned, and not what is determined via birth! WAKE UP CAYMAN! If you just pass one law for them wuthout weighing its consequences, you may open the door for others to be passed. And its hard to reverse a draconian law.

    Then you find some of your rights undermined for theirs. If you speak out or agree with these leftists, they use the powers that be to punish you! They will call you a hater, a bigot, a confused person, and the peer pressure will be great. But you must not cave in!

    The headline they use in their colorful marches to attract youngsters: “LOVE, LOVE, LOVE, all about LOVE and EQUALITY!”

    I am happy that you have very intelligent Caymanians seeing the difference of what really is a “right” versus a minority privelege. They are the rights afforded to every single person under the Constitution, but that the government denies to some (gay Caymanians) while not others (straight Caymanians).

  5. What does a "Judicial review" mean? says:

    “Judicial review” means :

    Judicial review is a type of court proceeding in which a judge reviews the lawfulness of a decision or action made by a public body.

    In other words, judicial reviews are a challenge to the way in which a decision has been made, rather than the rights and wrongs of the conclusion reached.

    It is not really concerned with the conclusions of that process and whether those were ‘right’, as long as the right procedures have been followed. The court will not substitute what it thinks is the ‘correct’ decision.

    This may mean that the public body will be able to make the same decision again, so long as it does so in a lawful way.

    If you want to argue that a decision was incorrect, judicial review may not be best for you. There are alternative remedies, such as appealing against the decision to a higher court.

    Examples of the types of decision which may fall within the range of judicial review include:
    •Decisions of local authorities in the exercise of their duties to provide various welfare benefits and special education for children in need of such education;
    •Certain decisions of the immigration authorities and the Immigration and Asylum Chamber;
    •Decisions of regulatory bodies;
    •Decisions relating to prisoner’s rights.

    There are some far-right Caymanian Christians that complain about what they perceive to be “class structures” in the Cayman Islands. For example, they feel that they are “unfairly” excluded from invitations to soirées and socials. That is absolutely true, but it isn’t a class division, it is a moral division. Quaint as they may be on the surface, the incompatibility problems stem from their militant theology, a vengeful appetite (ironically non-Christian), and a willingness to subvert civil rights and liberties against anyone…including their own. That makes them a prickly bunch. This issue is a prefect example of why I won’t be inviting anyone from Church of God (for example) to my house for supper.

    In light of so many posts and votes in support of “equality” and “non-discrimination” under the law, I trust all of you also support the prospect of Cayman facilitating these types of unions.

    Unless of course there is bigotry and discrimination within whereby you object to allowing more than 2 individuals (who love one another), regardless of sexual orientation, to be legally married, adopt children, and or raise a family, etc.?

    * The primary point of contention re gay marriage in Cayman (and elsewhere) is the limitation within the law to “a man and a woman”.
    If and when that is amended to read “any 2 persons”, for example, discrimination shall remain in respect to number of partners. *

    (Something tells me most readers, if they are honest with themselves, would have an issue sending their 8 year old son to a weekend sleepover party at the male trio’s family home.)

Spouses and dependents should have the legal authority to be allowed to stay with her, give instructions when she’s sick, and inherit their common property at the end. The Cayman Islands is already obliged to provide and DEFEND these rights. But most of all, the addition of these legal rights will not affect you or your household at all. Rights are not pie.

      Caymaninans have not rights here but the foreigners can be here as a couple. Caymaninans stand up for Caymanian cause this GOVERNMENT is all for that dollars from that outside person.

      Trust me I know it not right as the BIBLE speaks of a union to be a MAN and a WOMAN and I don’t like to see this but why import and we can’t accommodate our own.

Yes there is evidence of homosexual behaviour in all species, 5% maximum, but real evidence points to 1-3% including human beings. that is the strongest indicator that what is happening is not supposed to happen. Otherwise the numbers would support the argument that it is ‘natural’. It is not natural, it serves no biological function. If we then venture into human condition, then we have to also give the church its say, and they say that sexual sin (all forms) are evidence of the destruction of positive human condition… so why wouldnt they fight against it. Psychologists used to point to childhood trauma as one of the determining factors of homosexuality, but they arent allowed to anymore. So their analysis of the human condition has also been attacked, labeled as bigoted and silenced. At the end of the day we all have our beliefs, but arguments to change major institutions for what amounts to 3% of the population are suspect at best, regardless of who the 3% are and what it is they want.

        HOWEVER, it is NOT as an expression of care, “love” or reproduction – BUT as a means to HUMILIATE a competing male in FRONT of the FEMALE members of the tribe – as an ultimate expression of DOMINATION over said weaker male.

      Without a legal institution to recognize their union on island, the non-Caymanian partner has no immigration rights on island and there is a complete lack of recognition of their legal adoption from the U.K. (which would be recognized if they were an opposite sex couple), no succession rights (i.e. if one dies the other is not recognized as their next of kin), no recognition as the beneficiary of each other’s pension etc. and the list goes on.

      Honestly this rhetoric of marry elsewhere and move back to Cayman or have a symbolic wedding with no rights attached needs to stop because even if a same sex couple where one is Caymanian does so, they are still riddled with the issues above because the Cayman Islands does not currently recognize oversea marriages of same sex couples involving a Caymanian.

      The only reason why marriage is not available to same sex couples is because the Cayman Islands government discriminated against same sex couples solely due to their sexual orientation, which is not acceptable.

      It’s not that simple. Parents with dependent children must be responsible grownups. They need to consider their collective household’s welfare. The Cayman Islands currently bars these ladies, against the Rights afforded in the Constitution, and against legal precedents in our hemisphere of influence, from becoming a legally recognized and bound family household.

      For starters, there needs to be medical visitation rights, estate succession planning, household inheritance rights, and shared property rights. That could have been accommodated easily. It’s unfortunate that the public will be made to loose our money, defending an indefensible position in court, and will be paying these women their costs, interest, and penalties that the court may deem fit to assign.

      Heterosexual partners stand to benefit as well by having these common law rights applied to them without the historically compelling requirement to get married simply to satisfy our prehistoric Immigration Department.

    The government has no business getting involved in what is essentially a religious institution. If any number of individuals want to enter into a partnership agreement then that is where the government can get involved by creating a legal framework for those agreements.

        The government has, for its own reasons, hijacked the institution of marriage and as a result has introduced many of the relationship and family problems that exist today. Let the various religious groups have back the institution of marriage and then let the government create whatever legal framework is needed for two, three, four, five etc. number of people to enter into whatever partnership agreements they see fit.

      I cannot believe we’re in 2019, have freedom from religion written in our constitution, gay relationships are legal and common, yet politicians like julie are fighting against allowing two adults equal human rights on the grounds that the old testament didn’t allow it.

      I long for the day that a younger generation is elected and maybe then Cayman can be a secular democracy. Maybe then we can grow past Julie’s bigotry to ensure equality for all Caymanians. Nepotism isn’t about being family or friend – many benefits come if you’re a part of a certain religious cult here, entirely unfair.

          Why do they not do that In Honduras Roatan, or UK.
          How many have not arrived and say they love the Cayman Islands, but need it to change after they get comfortable.

          More than half of the world do not support same sex marriage. So stop making it seem that Cayman Islands is restricting anybody rights. Rules and Laws are in place for a reason. Get the Roatan girl a UK passport and both of you can travel around Europe and take advantage of the real world out there. No need to be stuck in this little Cayman Islands.

          And by the way. Cayman marriage Certificate would be useless in other countries. For all intent and purpose, it would only be a show.

            I agree with you up to the point where you said that a CI marriage certificate is useless elsewhere. Am a American citizen and for my Jamaican/Caymanian husband to get residency in America, we had to provide a certified copy of our Cayman marriage certificate in order for him to even proceed with his application. Once that was done he was given residency based on marriage to an American citizen.
