GT man dodges jail after machete fight

(CNS): Randon Odell Davis (20), who originally faced attempted murder charges following a fight with his estranged wife’s ex-lover, walked away from court Friday after a judge handed down a nine-month suspended sentence. On hearing the full facts of the case and the admissions that had been made by Davis, when he pleaded guilty to wounding as a result of excessive self-defence, Justice Greaves found that the situation amounted to a fight, in which Davis’ victim came off the worst. Given the defendant’s clean record, the judge decided not to send Davis to jail.

The fight happened when both men and the woman they had both had relationships with were at the same location in George Town because the woman had invited them there.

The woman had a fight with the complainant and reported back to Davis that he had hurt her finger during an altercation with the car keys. In the anger of the moment of what the judge described as a case of “a lady with two fools”, Davis and his victim had both armed themselves with machetes and launched into a fight, but Davis struck two major blows to his victim’s head.

The court heard that the attack was completely out of character for Davis, who was said to be deeply remorseful for what happened. But tempers had run high and Davis was faced with an armed man who was considerably bigger than him, and he admitted lashing out and using excessive force to defend himself.

The judge said it was a lovers triangle and could even be said to be a crime of passion, where Davis had gone to the aid of a “damsel in distress”. Justice Greaves said such cases are difficult to sentence because even the wisest of people can find themselves in this situation.

“I believe both men were responsible but one came off worse than the other,” he said, before he handed down the nine-month term and suspended it for a year.

Just because someone has a law degree does not make them wise. A position of power does not connote common sense.

bottom line is…the woman has done nothing criminally wrong….but…….

Deportation for the three of them –

I am of the opinion that this woman wanted to have two men fight over her – this is why she invited both men to the location. What ‘lady” behaves in this manner? Inviting your Husband and ex lover to the same location at the same time. She had to know nothing good would come from this. However some women enjoy men fighting over them……I am a woman and I find that kind of behavior childish and stupid.

What part do you not understand? Both men were carrying and therefore should be prosecuted.

The prison is full and we can’t lock people up for serious offenses. The criminal community know this, which is a very frightening reality.

I don’t know how these overseas judges are recruited but this sentence does not seem even close to appropriate to me based on the news item. 2 grown men deliberately attacking each other with machetes with one man getting serious injuries and no one goes to jail??? They should both have gone to jail. Grown men dueling with machetes may be normal in places where they come from but it is not OK here and we do not need judges sending a message that it is OK.

It was excessive self defense! In other words he continued the attack when his life was no longer threatened. Imagine if only one person had a machete?

How can that be any kind of self defense when he went to a confrontational situation with a machete. It was all because he had no previous convictions and good boy , the others pleaded for him .

9 :38am I completely agree that Cayman is not serious about fighting any kind of crime . That’s why they can go to visit a damsel in distress and both are are armed with machetes , and the winner is the winner at the scene, and the Judge feels the same way in Court too . I want that Judge to be on my upcoming case .

What exactly does it take to get a prison sentence here?

When you strike blows to a person’s head with a machete you are at least dealing with GBH if not attempted murder. This boys will be boys judicial attitude does a disservice to the community at large.

Jesus H! The sentence for this should be custodial and measured in years. Attacking someone with a machete!

The “lady” involved doesn’t sound lke a damsel to me. Such language indicates the matter was treated like a joke. When people go and arm themselves for a fight, they should get some jail time, even if it’s just a month or two. Tolerating public mayhem like this indicates Cayman is not serious about fighting crime.
