Clement Reid

(CNS): Despite finding that the litany of questionable actions by Port Director Clement Reid exposed by the auditor general did amount to gross misconduct, the Port Authority of the Cayman Islands (PACI) Board gave him a second chance because of his long service with the authority, his willingness to try to put things right and a commitment to do a better job. The board sent a warning letter to Reid in February, which has now been published by PACI. It reveals that a decision was made to not fire him but to give him a month to resolve the problems he created and place him on a 12-month probation period. 

The letter states that the board was “generally displeased” with the “sufficiently serious” misconduct exposed in a special report by the Office of the Auditor General that he could have been dismissed.

The members were particularly concerned about his failure to abide by the Public Authorities Law and Port Handbook when the director created several new jobs with inflated salaries, which they said had led to an unsustainable payroll.

Instead of firing him, the board ordered Reid to address the human resource problems and to deal with how wrecks would be handled in future, after claims in the OAG report that Reid had given an unclaimed boat to the wrong person.

The letter focuses heavily on these two issues and makes only passing references to the boat engine thefts, the excessive and allegedly unauthorised spending on the redecoration of the director’s office, and the permission given to a staff member to take 63 days paid leave in one year to assist then opposition leader McKeeva Bush. The letter required Reid to create new policies regarding these issues.

The board found Reid’s actions regarding recruitment alone justified firing him on the grounds of gross misconduct, but said they would not “adopt such a draconian course”, that the members would give him the “benefit of the doubt” and an “opportunity to make amends” by addressing the misconduct.  The letter stated that if he was able to address the personnel issues within 30 days, which would have been the end of March, he could keep his job.

Indicating that it would not tolerate any repetition of mistakes, the board said that if there was any further misconduct over the next 12 months he would be sacked immediately. The board directors said there could be no repeat of the actions but he had a chance to address the problems he had created. They also imposed new reporting rules requiring Reid to submit reports to the board every two weeks rather than monthly.

In order to address the other issues, Reid was given a 45-day window to come up with the creation of a new budget schedule for any planned overseas travel — another deadline which has now passed. He was also directed to come up with policies to address issues such as disposing of authority assets and a procurement policy.

Aside from giving the director another chance to get things right himself, they also indicated that a sub-committee had been created by the board to help him come up with a plan to address the HR issues. The members of that committee are Richard Parchment, Ken Thompson and the ex-officio member, Collector of Customs Charles Clifford.

CNS has repeatedly contacted the board and the tourism ministry about the situation but no one is commenting on Reid’s future. It is also unclear if the director has met the requirements imposed on him to stay in his lucrative post.

    When this occurred at another sister authority 2013 i don’t recall the outrage and agenda laden posts and the vicious statements yet far more cost and larger amounts of money and property were taken certainly more incidents of outrageous misconduct were cited. Same players on boards blatant nepotism and cronies appointments. The then chairman was even investigated on corruption allegations after a new board and chairman and CEO were appointed by this same government which was filled with brethren and with very serious conflicts of interest. Not a word from you posters only difference then it had the backing of then very conflicted UK governor and his stooges who’s hand and political and economic agenda was very very clear from the very onset. Down to him instructing relevant persons to award certain contracts to a certain Commonwealth country government whom they had political and financial interest. Yes Rick dear God forbid we should remember such things eh? especially when it is done to us by bastions of the pious UK Government where corruption is a myth. Yes and to all you frigging hypocrites please deal with your own shit before start pointing all calling out others. Yes please give us back our Tempura money and while you at it remove all those employed locally at the ACC, Police and others gov’t institutions the cost us over 20,000,000 Million. Better yet minus $136,000 spent on the port from that?? Yes that should give you the scope and breathe of your whining and moaning about the port director.

    Here we go again, McKeeva Bush in the middle of things.

    Does the Honourable Speaker of the Cayman Islands Legislative Assembly believe that it was honourable to soeek out a close family relative of his that works at the port and ask that the port employee be allowed to accompany him on overseas trips? That family member subsequently lost his job at the port authority after being arrested on drug related charges. Does anyone in their right mind believe Mckeeva still has “clean hands and a pure heart’ and did an honourable act?

    In most right thinking countries in this world, the Speaker of the Parliament would have been asked to resign as Speaker because his actions were not honourable at all. Premier McLaughlin cannot do this because his government would fall apart without Mckeeva’s support and so to Premier McLaughlin, remaining in power is the most important thing, A little wrong-doing by mckeeva is not worth the government losing control. These Islands are in a sad state and there is no credible alternative to this government

    Mr Reid has made some very serious mistakes that cannot be brushed aside easily.
    it is such a shame because he has a good brain!
    I know that new findings are being discovered even after the Auditor General report was written and more will continue to be discovered because there are those within the port authority that will leak information of more wrong-doing by Mr Reid, not because they are so much concerned about stamping out wrong but rather they hope to get an Acting position out of Mr Reid’s departure.
    The Board cannot command an ounce of respect from the public if they allow Mr Reid to stay, especially as more wrong doing will come to light. what message would this be sending to the rest of the civil service and the public, that you can get away with serious errors involving public funds?

    Sadly, there should only be one outcome from this, the Board should dismiss Mr Reid.
    If he stays, the public will not trust or respect him. If he stays, the Board will also lose all credibility in the eyes of the public. With an increasing tide of new discoveries against Mr Reid, the Board should dismiss Mr Reid. His dismissal will send the right message that wrong will not be condoned and, the Board will retain some twinkling of respect.
    Mr Reid needs to go, if he stays the negative stigma and loss of reputation will follow him around making him a lame duck port director.
    Make the right choice Mr Reid, resign. If Mr Reid does not resign, the Port’s Board needs to dismiss Mr Reid.
    A sad end.

What a mess this government is in, what a pitiful example for the young Caymanians who are trying to make it on these islands where people and companies have already labeled them lazy, incompetent etc. We have many young intelligent educated Caymanians who could do very well and some are but behavior like this does not paint a pretty picture. Please cut the puppet strings and let’s start cleaning the government houses. There are many qualified Caymanians for these positions who are not politically tied or rather paid off. Time to get the big can of raid out and start spraying, smh.

    I have not see any response from the AG or the DG or MLA’s or Ministes regarding this decision of the board to give him a second chance.. Is it that we have all missed something here. Has the PD or the HR done anything regarding cutting these high paid salaries or made their positions redundant yet. I must have missed that memo because I have not see it. His warning letter stated the obvious regarding what he was suppose to do to reduce the Port authorities salaries and I don’t mean fire or get rid of the small men to keep on his friends with those dig salaries either. Redundant means just that. Why is it that he just got a slap on the wrist and still is the port director is beyond me. So them is he that powerful that they had to give him a second chance so he can continue his bad ethics and bad decisions of running the Port authority. I can only imagine what his staff is feeling right now. That place has no moral no accountability for doing wrong. I’m sure that those hard working men and women excluding the ones with the big salaries are all feeling like this is a really big joke to them. With all the reports from the AG the PD’s response his big ego and cocky ways he will not change nor will he cut those salaries for his friends. What he will do is try to cut staff in anyway possible to distroy people’s families or take away their livelihood as I see it. There’s no other way for him to reduce that big annual salary budget otherwise. All I seen here was him putting the blame on his HR manager that has now retired and tarnished her good name and the CFO making him look like a damn fool. Why? Wasn’t he a deputy director for many year before so how could he make such mistakes with the financies when he knew good and well what he was doing when he gave all those people such nice fat salaries over their salary bands. They all need to be redundant and make the PORT A BETTER PLACE AGAIN… HE SHOULD HAVE BEEN FIRED AND SINCE THAT DIDNT HAPPEN HE SHOULD HAVE BEEN DEMOTED AT THE LEASE BUT THAT DIDNT HAPPEN EITHER. HECWAS GIVEN A SECOND CHACE… WHAT A SHAMEFUL DISGRACE THIS HAS BEEN. I guess this will be the last we hear of this matter happening. But I’m sure it won’t be the last.

      As you may have seen in all the write ups and downs NOTHING WAS REPORTED TO THE ANTI CORRUPTION UNIT. So that means that NOTHING that the AG has said or the BOARD has said has left that Port building or wherever they hold those meetings. so as you may see it like I’m seeing it if they didn’t report it its WHY HE WAS GIVEN A SECOND CHANCE… This is the worse thing that could happen because if they had reported it he would be on SUSPENSION now.
      If money was mishandled or as he has said there was misconduct with funds and those engines as well why wasn’t it reported..     To say that the actions of the board squarely puts them as accepting the BEHAVIOUR of their beloved PD would be a gross under statement.

    When a candidate that scored lower than 3 others and is given the job with a salary that is beyond the scale is in the writers opinion favoritism and nepotism. The DD for HR that was hired knows nothing about HR. XXXX

    The board needs to held accountable just as the PD at this time as they have now accepted his wrong doing but instead of sacking him they say “now boy don’t do it again as we are giving you a chance”. Hell, the theft of the boat engines alone would be grounds for termination.

    In closing, if a customs officer and immigration officer can get arrested or put on leave for offenses that have not been proven or admitted, then why in the hell hasn’t Clement Reid, the Board and some Ministry personnel not gotten terminated for what has been proven to be willful failures to follow 2 Laws and for what I would term, misappropriation of funds.

    This whole fiasco is sickening and the uproar from the government is deafening. NOT!!!!!!!

      Yes i totally agree with you on this matter. All of the above is so correct and the over paying of certain staff members are still the same. NO CHANGES there.. why has the board not pushed the issue of getting these position redundant like they said in his warning letter. Why is he still allowed to have these people in these positions wid such big salaries and the workers that actually do all the work has not been considered to even $100 increase in their salaries. They are the ones that spend their nights at the port doing all the work and these people can go home at 4pm n relax with their families while the workers are at work all night from 6pm to 5am and sometimes later. Some of these people knows nothing about the operations yet they are the ones that are collecting this big salary at the end of each month and when they are at work in their newly renovated offices wid their legs cocked up on their ottmans. The staff of the Port Authority needs to rise up. Those hard working men work everyday to make the money for the port and yet they are not even compensated for their hard work. People always say that the Port staff make too much money but i wonder if anyone would quite their 9 to 5 job to do what these guys do?? They work in the rain if theres bad weather or any other reason to get the work done. Their days off they have to work or be called into work because of being short staffed. Did anyone know this. Probably not because of the power that has been given to one of the newly promoted deputies. That man also has too much power cause he was the one to suggest that the guys shifts be changed for more family time blah blah blah but thats not the case. These workers are being over worked and underpaid and yet the port and does not see this. They work day and nite. I wish that those port workers had someone to help them get through all the roller coaters that they are going through. But look at it from my point if view if they couldnt fire the PD how or who can help the workers now.. Aint a single word from any of the Government, AG or the CO to try and step in to help sort out the problems at the port instead the AG’s report did absolutly NOTHING except show the island what has been happening. The Board has done nothing but a slap on the ass to this man or in better terms kiss his ass. Why has or is he so powerful. Who is it that he has information on why they wont get ride of him. Could it be the APEX consultants form or the new cranes that has been brought in. I really wonder. At this point someone has to take the glory for those cranes and that saying is we are the only ones in the Caribbean with those cranes. Really so why has all the other countries even the USA gotten rid of them?? They aint worth having but wait a while maybe a good hurricane will show them.. Lets just wait n see. Or better yet if because of the PD years of service and its gonna cost the Port so much to fire him then just sell the damn cranes back and pay him off get him out

          I personally don’t think it anything to do with JEALOUSY here. The matter of the fact is that I have personally spoken to the port workers whom tried to get a meeting with the DG and all now NO RESPONSE FROM HIM. What someone has his hands tired along with his brain I guess. These employees are a part of the Government wether we like it or not, so why now that they are asking for his help that he has turned his back to them. Remember the higher you climb up the ladder is the same way you can reach the bottom. He is responsibly for all government employees wether it’s a statutory board or an immediate civil servant but what comes to my mind is wether he’s also a Lodge member because remember they have to look out for one another regardless. What the DG should have done was call a meeting with the PA staff, hear their concerns and try to do whatever he could to assure them of their jobs their pay and whatever else just like how he does every month with the civil servants employee of the month and so on. He has not responded to anything thus far regarding all this and I’m quite sure he was a part why the AG was notified about all misconduct with the port authorities Director. Take a look at the warning letter that was given to the PD it plainly states that he must undo all the wrongs he did and/or get rid of staff which he tried to do like the port truckers and security and even the people who are 60 which retirement ain’t til 65 so that he can try to save money to keep his goonies in this high end paying jobs. Now to my knowledge it was probably about 8 or 9 people that he hires that was his good friends, friend of friends, brothers law, nephews sister are amounts these hired and paid more than the salary band that was advertised for this positions. So you can see it has absolutely nothing to do with JEALOUSY. IT HAS TO DO WITH WHAT HE WAS ALSO PUT IN THAT POSITION TO DO FOR ALL THE EMPLOYEES OF THE GOVERNMENT.

    Well look at this now…my how the tables have turned. I guess him creating positions for people XXXXX didn’t work out the way they hoped. Last year they advertised big paying jobs but gave them to unqualified people because of connections, but look at that now. The board should review everyone’s salary and demote him. Other authorities’ CEO that were in the heat in the medias eyes a few years ago got fired but this one remains? What goes for one should go for all. He can’t create positions and big salaries for people just because he knows them.

    This could only happen in the Cayman Islands. It’s the age old Caymanian way – “you scratch my back and I’ll scratch yours”. So many locals have dirty little secrets they will excuse others to preserve them. If Reid who has lost all credibility is not sacked immediately then the whole of Government has no credibility either.

      You couldn’t make this stuff up if you tried, doing what the board has done, makes them just as stupid or corrupt as the Director…either way they should all be sacked for sheer incompetence, nepotism and for a total lack of accountability

        The CEO, the Board (who first removed a competent and proven/tested CEO in the person of Paul Hurlstone Jr, XXXX AND the Government Minister AND Premier who have been NOTABLY SILENT about this ongoing fiasco, should all be shown the door..According to the PPM’s manifesto, they were a Government of transparency and accountability. What a crock of “do do”…Time for us to “chase the crazy baldheads out of town”.

      This is worse than I can ever imagine… Imagine how his staff feels now that he has been given a second chance so what about the one that was forced to resign because of those boat engines. Where’s the justice in that matter. Shouldn’t he be given a second chance too cause I’m sure he was and is a very good friend of the PD.

    My goodness, please give the guy a break. It makes me so sad that my fellow citizens are so willing to crucify our own. Don’t we all make mistakes and have slips in judgment? I’ve always been taught that you have a consequence, then be given a chance to rectify the mistakes. The consequence is that the board has put the necessary checks and balances in place to ensure additional accountability while putting him on notice, not to mention the embarrassment of all of the negative publicity.

Granting someone leave thinking the already short staffed department can handle it is a slip in judgement. Doing what he did is a complete lapse of judgement. It was a “slip in judgement” he was appointed to begin with.

      You’re right. He should pay back the payroll for the positions he improperly created, the paid leave for those salaries, the office renovation costs, the stolen wrecks, and boat engines. Then he should be fired for cause, and the Board reviewed by ACC.

    Let see…A surgeon kills or mutilates patients for the lack of education, experience and inability to understand rules and regulations; a baker bakes bread you can’t eat; an enginner designs buildings and bridges that collapse; a pilot nearly crashes an aircraft for he doesn’t know what he is doing. Is it possible in a real world? Obviously it is possible in the Cayman islands. And you even get a second chance. Is he at least going to attend some educational courses, preferable the one that require examination upon completion and obtain some sort of relevant certifications?
    When you’re qualified to pave driveways but was given to manage the country’s education system, what do you think is going to happen?

    By any standards this list of wrong doing merits dismissal, and more! So what this really calls into question is the merits of the overseeing Board!
    The only one to come out of this without a stain on his character is McKeeva, ok it would have been obvious to most decent people that it was wrong to accept the services of Government paid personnel for personal ends, but I bet there isn’t a written and specific Government ruling on that, yet! And anyway, as long as he now reimburses the money, he’s fine by any standards. Isn’t he?

    The entire PACI Board of Directors must now be replaced by Cabinet as a result of this letter. Additionally the port director must be fired for gross misconduct. There is no accountability within the Cayman governance model. Port, garbage collection, multiple ministries it’s the same nonsense and corruption. Time for the Governor to intervene to demonstrate leadership and set the new standards of accountability.
