Damages claim filed against police over assault

PC Michael “Bobby” Peart

(CNS): A legal claim has been filed in Grand Court against the police commissioner, the attorney general and police officer Michael “Bobby” Peart, who was found guilty of assaulting a man during an arrest but who walked away without sanction when a magistrate chose not to record a conviction against him. Glen Andrew Bush is seeking damages from the defendants in relation to the beating he says he received from Peart in November 2014 in a patrol car and at the George Town police station.

Bush states that during an arrest, Peart threw him on the bonnet of a police car and shortly afterwards hit him with a baton when he was in the car as it traveled along Eastern Avenue to the Central Police Station on Elgin Avenue, while he was handcuffed with his hands behind his back. Bush also claims that he was beaten at the police station “violently and unlawfully”, as Peart grabbed him forcefully by his neck and squeezed it.

Bush said he was prosecuted without reasonable cause on charges of intentional harassment, alarm or distress, assaulting an unnamed female police officer, resisting arrest and assaulting Peart.

The legal claim for damages also notes that Bush is taking action against the commissioner and attorney general because Peart beat him while on duty as a police officer with the Royal Cayman Islands Police Service.

Peart, who had denied the allegations, was successfully prosecuted for the assault at the end of last year. But once a decision was made not to record a conviction against him, he was returned to active duty earlier this year following a short suspension.

    Some of you people haven’t a clue what RCIPS have to deal with on a DAILY basis with these criminal idiots! I was a female Police Officer here and was spat at, verbally and physically abused, cursed at, assaulted, the list is endless. Yet I still carried out this job to the best of my ability to protect and serve the people of these islands. So please don’t talk about “rights” of these criminsls. They aren’t arrested for being law abiding citizens make no mistake about that! If you believe them, Northward is full of “innocent” people. Behave yourself, act appropriately and abide by the law of these islands and you will have a good and peaceful life.

    Bobby is one of the RCIPS finest. If we had 350 like him we would be in a lot better position.

    Glen just went to HMP Northward recently for Contempt of Court. (Bad Attitude in front of a Magistrate on Domestic Violence Charges) Glen has a bad attitude from the time he was a juvenile and that’s why he got his ass beat by Peart, who is a gentle giant for those who really know him.

    If Peart hit’s you in the line of duty it’s a 99.9% chance that you deserved it – which is why he was not penalized by the magistrate in his case, although being found guilty of using a bit of excessive force. (Assault)

    The Crown should give him $100 CI in compensation and he should then go and get Extensive Anger Management Counseling.

      It is not for a police officer to “execute” a suspect.

        When I were a lad, back in UK, that’s the way the police dealt with local thugs. Kept them under control, stopped a few from becoming career criminals, but if they overstepped the mark again they had the book thrown at them.

      This lawsuit it NOT about Glen Bush, but seeks to send a message to all police officers. The police is NOT the judiciary and it is not for them to exact or decide the punishment of a SUSPECT. Yes, suspect as not everyone arrested will be charged and must treated fairly. In this land the presumption of innocence is the rule!

      NO ONE deserves to have “a bit of excessive force” used against them. It is damn wrong and illegal. Shame on you that you think it is right for police to think it is ok for police to brutalize people because they feel it was deserved!

      More heads need to roll for police brutality.

      In this hear Cayman Islands the only person exempt from the rule of the land is the Queen!!!!!

    I hope Mr Bush wins. I for one know how corrupt some of these officers are and just because you’re having a problem controlling a suspect who is unarmed does not give you the right to put your hands on them (while they’re handcuffed no less). We won’t learn until this stuff happens so often and it finally starts affecting us all and not just the so called ‘bad boys’. I for one would prefer we deal with these issues now before the police beat me and I have to take actions into my own hands. I also hope Sandra Hill wins. These people need to be held accountable and stop acting like they’re above the law and above the same people who pay their salaries.

        When you take on a job such as a Police Officer, you must know that at some point in your career you will have to deal with all walks of life. If you think you can have a career without having to deal with just about everything at least once then it is you my friend, who is the real idiot. Again, no one has a right to touch me or put hands on me for any reason. I’m not a police for the same reason, I would beat you if you spit on me. But knowing myself I didn’t apply. If Mr Peart can’t handle saliva he need to retire and find something else to do. No one is giving the criminals the right. I don’t want to live in a country where I have to be afraid that if I’m angry in a situation, the police officer that attends may be unhinged and cause me harm rather than do his job. I hope you understand.

        For fear of my own safety and becoming a target i would not dare speak what i know. Plus, most of what i would post i doubt CNS would approve it. All you need to do is start looking into what duties this officer was doing back in 2008 – 2010 and then ask why he is not doing these same duties and what happened to most of the officers he was doing these duties with.

    This is how the criminals win. They get a little slap around and a broken arm and then they use that as the reason to cause more problems. Whichever way it goes, Mr. Peart you have some people respect. Most officers I know do not just wake up and say they will go on an abuse hunt. If provoked by some criminals, I say beat the hell out of them.
    It’s so very rare to hear a police story of abuse that includes a member of public that has no track record of criminal behaviour.
    When you watch youtube videos of police abuse. Do a little google research and see what happened before that cause the interactions. You would be in a situation that you would say, if that was you as the officer you would have not been so nice.
    The lawyers putting this crap in the criminal heads should be ashamed of themselves. They never seem to have a soul or already sold it.
    To watch criminals taunt you after you know and they know and the lawyers knows the person is guilty is very vexing and not everyone has the patience of Job.
    Mr. Peart hold your head high. You have done more in the community than those criminals or his Lawyers have or will ever do.
    Next time put on the boxing gloves and punch them harder straight in the face and explain to the judge you was giving free lessons of boxing. If the criminals can have one up, you can respond in kind as well.

    This man was resisting arrest and a baton is provided to police officers to assist in the arrest in these circumstances. If officers have to treat these people with kid gloves then a large number will escape.
