Former fugitive guilty of robbery 6 years after crime

(CNS): Dan Kelly (24) was found guilty Monday of robbery and possession of an imitation firearm in connection with a stick-up at a West Bay bakery in 2010. Following a judge alone trial before Justice Charles Quin in August, the local man, who went on the run while on bail for the offence, was convicted of a joint enterprise six years after the crime. His co-defendant, Derek Simpson, who pleaded guilty, has already served his time but Kelly, who is already serving time for other offences, is expected to be sentenced next week.

Kelly had denied the crime, claiming that he was hiding from the police in the bush because he and friends were smoking weed. But at the time of his arrest police officers found, hidden in the undergrowth, a bag of clothing that matched the description of the two robbers and the imitation weapon with Kelly’s DNA on it. He was arrested on a rainy day with no shoes and no shirt.

Justice Quin said he did not believe Kelly’s story and his highly implausible account of what had happened and was satisfied beyond all reasonable doubt that he was the second robber in the armed robbery, in which around $400 in cash was stolen.

Pointing to the CCTV evidence, the DNA and the circumstantial evidence, the judge said he had reviewed all of the evidence with great care and he did not accept Kelly’s explanation for being half-dressed when he was arrested or why he was in the bush. He said that together the powerful and reliable evidence against him created a conclusion of guilt with as much certainty as could be expected.

    Good to see common sense applied here. It seems that the defence lawyers manage to get Jurors really hung up on the ‘ beyond reasonable doubt’ piece. See recent trial in which Steve McF managed to imply a need for ‘no doubt’.

    Leads me to a question? Who decides if it is going to be a jury or judge only trial. Seems to me we get some bizarre jury acquittals but some pretty common sense judge only decisions. If you were in the dock which would you choose??!!

        To be objective, i.e. Not related or a West Bay criminal apologist, he is a useless sack of garbage. This sort are best kept in jail until their testosterone levels fall in their 40s.

              You have no respect OR any sort of knowledge towards his case. He left the island, but in his own will, he came back to deal with his issues- people can change and it seems like the whole of Cayman can’t grab that concept. This is why it’s too hard for our community to change for the better- people are too busy judging and calling names. He’s a creation of God; God does NOT make garbage. No one is perfect; now let him be and stop putting labels on people’s children. You’re the one that’s going to be shock when he’s finished serving time and come out to be a better person, God’s willings.

                Thank you, you couldn’t had said it any better. People are always quick to judge someone based on what they’ve done in the past or what society says about them. I can guarantee if it was their brother, son nephew, father husband etc they wouldn’t like people speaking about him like how they are. Some people just get a high out of other people’s downfall while other try to help pick them back up when they have fallen.

          Stop throwing stones at people downfalls I guarantee you have lied at least once in your life time stop trying to make out as if you are this perfect human being cause no one is. We have al done wrong is some sort of way. Why kick people when they are down instead of helping them up. This is why Young Caymanian feel as if they can’t rely on their own people as all everyone does is kick each other down. He is a HUMAN BEING like you are there is no need to call Him garbage. You are difinetly not GOD to be judging anyone due to their actions or mistakes.

      Kids like him should spend at least five years or more in prison. Too bad our prisons is too soft. I have boys his age and if they do things like this then i say the same for them
