Marriage deceit draws nine-month term

Cayman News Service(CNS): A Jamaican man who committed bigamy with a local woman received a nine-month jail term last week but he was released from prison Thursday having already served six months. The judge recommended that Barrington Neish be deported, as he suspended the last three months of his prison time. Describing Neish’s behavior as a “wicked deception” that had caused his duped wife and family significant distress, Justice Charles Quin said he hoped the man’s time in prison had taught him a lesson.

Neish was sentenced on Thursday after he had been remanded in custody several months earlier following a trial. During the hearing he was said by prosecuting counsel Toyin Salako to have committed a particularly egregious act of bigamy, as he had not only lied to his wife, he had also tricked her into getting involved in his deception when he asked her to get the documents notorized that he knew to be false.

The couple married earlier than planned as his then fiancée’s father was fatally ill and she wanted him at her wedding. Neish’s bride, however, had no idea that her husband to be was still married to his first and only wife and had never even initiated divorce proceedings.

The judge said that Neish, a former law enforcement officer, knew full well when legal documents were false and was only caught because the immigration department raised the alarm about the forged documents he submitted.

But after he was caught, instead of admitting his act of bigamy Neish continued to deny his culpability. He falsely blamed an attorney for his failure to divorce his first wife and put the local family and his bride through the trauma of a trial and what was described as “untold humiliation”.

    And worst are the Jamaican women who cater to the every whim of a Caymanian man to secure a marriage and pregnancy.

    The marriage is one thing, however the pregnancy and birth of a Caymanian child ensures her continuity here even after a divorce. Parenting a Caymanian child just about guarantees not only PR with employment rights, it also guarantees access to legal aid, maintenance court, social service benefits, fee schooling and much more.

    I am not sure how many Caymanian men have had their fair share of experience with this – the woman is very convincing, loving, nurturing and fulfills his every desire. Then two months after the baby born or the wedding band is in place, the other side of her shows up.

    Cheating (especially with their own). This is not at all uncommon. I know Caymanian men who have even written immigration and meant with the board about their “wife” because of infidelity – even going as far as having evidence. The board does absolutely nothing, especially if the couple have Cayman-born offspring.

    Worst if the man initiates the divorce proceedings and gets in front of a Jamaican judge with his Jamaican wife!!! No mercy, no mercy, wow! Our court system is so biased in these situations I am surprised more men have not come together to file complaints and campaign for a review in to these cases! The lack of judicial process, obvious oversight and bias… believe me, it is very, very, very common. But just like domestic abuse against men, most men remain silent and accept their blows in these situations.

      You should also mention the :caymanian” women who marry a foreigner or Jamaican and once he buys a house try to get him kicked off the island. Dont know about that ,huh?

        Chances are he was only able to buy the house because he was married to her anyway and able to get stamp duty benefits because of that too. Not to mention his links to a Caymanian woman would have made it much easier to secure the job that convinced the bank to issue the mortgage that the house was bought with.

        And if your theory is correct, the woman would obviously have to be self-sustainable and financially stable in order to “kick him off” because if she cannot satisfy the bank that she is capable of paying the mortgage herself then it would be very stupid to “kick him off”. Soooo…. obviously that would prove that she did not need him to get the house in the first place. #debunked

        I am aware of the Caymanian women who live in fear to divorce their abusive (physical, emotional, financial, you name it) expat/Jamaican husbands though… that one is common too.

    I suspect we are watching a bit of history unfold. I would say a possibility exists that this is one of the last Bigamy cases to be prosecuted in the Cayman Islands. Surely, when deceiving a person they will be prosecuted for other things but times are changing and they are changing fast.

    In a few short years, you will see the end to the war on ganja and the last person to be prosecuted for simple possession.

    In the next decade you will see the marriage being replaced by the simple contract as the next generation refuses to enter into such opaque arrangements. Quite rightly, if anyone can get married then no one will want to. Simple human nature ….they will demand starting in the US and Western Europe save maybe Spain and Italy a recognition of legal partnership with contractual rights which are triggered after a certain amount of years.

    Lots of jaws dropping with the legalisation of ganja like wow that seemed impossible. This is the next shoe to drop as the next generation has a totally different view on marriage. We see it as an opaque arrangement devoid of any religious element that is judged by judges who don’t apply God’s law but rather the law of Man. Therefore, it has no sanction of God and need not be entered into. If we have a religious foundation we can simply marry in front of God with a partner for free with a promise to God the almighty.

    Us young people don’t have any money to give away to Governments and the like and when things go wrong to the lawyers and the courts. Better just sort it out without that and explain the situation to your pastor and seek his help. When people (or the pastor) question it, just say how did the people in the Old Testament get married and was that in a church or was it before God. Exactly, it is a union in front of God only and without God you won’t have me getting married and that is what a marriage is now Godless in front of the law. The church can then go to the politicians and fix that while I am happily married before God whose love is completely free (it is an amazing concept God’s love)

      Marriage is not a matter of law, it is a matter of spirit. Two humans deciding to walk this planet together “in sickness, health, poverty, wealth… etc.”. It is your life partnership with another human.

      No court, church, government department or any other human-assigned regulatory institution should be given the authority to dictate whether you truly do or do not love the person you are with.

      I find it so frustrating when people insist that two people marry because they have been together a number of years or have children together, “oh you too should get married now”.

      So, what you are trying to tell me is that my partner and I do not have a REAL marriage/relationship because I have not yet paid our government for the right to call him/her my husband/wife?

      Seriously?

    Again we continue to not see the issues of having so many jamaicans here….. they have had to struggle, be aggressive, corrupt for so much, heck they can’t even go in a line without trying to ‘cut ahead’. All Jamaicans who are honest & hardworking need to help stop this or leave with the rest.

    Wow, he obviously did love his new wife enough to divorce the first one… obviously a marriage for convenience. This is so sad, I could only imagine this woman’s frustration now; and chances are this clever fox will sooth her with words of comfort through it all. Deport and ban him.

      Oh please marriage is to control women not men. The men are in the bar and the women are at home pining away while the man jumping everything that he sees. I’m a woman and I would rather not be married. My father said that all men want is to make women barefoot and pregnant while they carry on with their shenanigans. As for a Jamaican, there’s no such thing as a faithful Jamaican man.

Lack of diligence to start with if he was employed by the CI government as no doubt he would have had to acknowledge his marital status on his employment application. Lying on that as well as to the woman he married certainly illustrates the kind of person this individual happens to be. Deport him ‘YES’ along with others who are serving time at HMS North Ward Prison for equally or worse crimes in which they have committed right here in the Cayman Islands.

      CNS readers that is only a part of the problem. History is going to be made soon in these Islands when some women namely from Jamaica who is using a married man to suffice the needs of her four children and instructs the husband to disrespect his wife of 32,years who brought him from nothing to something. Roll over is around the corner and she needs the infamous ring and paper. There is so many like her out there but we must stand up as women let these men suffer the consequences of their actions. Stand by all for the outcome. The Court date is being finalized.
