Mac sues over failed criminal charges

McKeeva Bush, Leader of the Opposition

(CNS): The opposition leader’s lawyers have filed a much-anticipated lawsuit against former governor Duncan Taylor, Commissioner of Police David Baines and Attorney General Samuel Bulgin in connection with his arrest, charges and subsequent trial over abuse of office allegations regarding the alleged misuse of his government credit card. Twelve months ago McKeeva Bush was acquitted of eleven corruption charges that alleged he used the card in casinos to draw cash for gambling on slot machines.

Since the jury found him not guilty in October 2014, the opposition leader has persistently indicated he intended to sue, as he said the accusations were nothing more than trumped-up charges designed to derail his political career undemocratically and oust him from office and undermine his chances in the 2013 election.

Bush said he would take legal action regarding the alleged conspiracy against him and it is understood that the veteran West Bay MLA is seeking millions in costs and damages.

    He will presumably be suing in the tort of misfeasance in public office. That requires proof that a public officer knew they were acting illegally. It almost never gets off the ground. He is on a hiding to nothing. And those who make such allegations and fail usually have to pay indemnity costs.

    So who’s going to pay the legal fees and potential payout? The U.K. or us Caymanians? If the UK then fine but if not, why is this guy suing us? I thought he was an honorable man and cared for us.

    Is he upset because of OMOV, realizing he’ll never have the perks of a Premier? Does he need to supplement his income because of this?

    So essentially what this means is that everyone who has been charged with a crime and then found not guilty can turn around and then sue everyone? Oh boy!

      You can of course sue. Winning is another matter, and the outcome will not be decided by a jury. You would have to show that the charges were unreasonable. And if you lose, you get to pay your own costs and the defence’s. Better have a big budget and be able to afford to lose before you go down that road, plus allow for all the allegations to be re – aired in public and the media.

    Reading all these comments makes me realize how silly some people are. So you expect this man whether we like him or not to take the embrassment, ridicule, stigma etc that we as a country exposed him to and just sail off in the sunset because he loves his country.

      To support a man who was the Leader of this Country, who gallivanted around the world gambling with our money, who then get off because there wasn’t a piece of paper in place telling him he was not allowed to do it is a complete slap in your face, my face and everyone who lives in this Country by Mac.

      Now, to further shove it up our arses, he is going to sue us. He belongs in prison or a retirement home and the sooner he goes to either, the better off our Country will be.

      If his actions were done by someone in a position of trust in the private sector, they would be in prison long time.

    I just lifted this excerpt from the Compass: The writ goes on to claim that the charges made Mr. Bush the subject of “public attention, contempt and ridicule” and resulted in irreparable damage to his reputation both locally and internationally.

    How many here are worried that the Crown might call you as a witness to say you viewed him with contempt and ridicule long before Baines or Taylor ever arrived in Cayman?

      The fact that he was found not guilty does not mean it shouldnt have been brought to court. I find it hoprrifying that he did in fact withdraw more than $50,000 from a public credit card to gamble with, and would have been outraged if he had not been charged. We all have our own view on the verdict, but no-one can possibly say that he did not have a case to answer.

    Oh boy … something tells me that this man is going to use his court victories to not only get reelected, but once attain power regroup a new party and not rest until he brings down his enemies. The new electoral system is not going to hurt him from getting back in power one bit. Like Trump in the United States, he’s going to use negative energy to his advantage.     Firstly, a trial by Jury in Cayman for a politician is not an unbiased trial. Secondly I’m sure it didn’t cost him millions in damag; but once again he’s showing the he has no concern for how his actions will impact Cayman’s reputation or finances. Unless he intends to take the issues up with the courts in the UK; this is just a process to hupe up his supporters (not sure how he still has any). Think it is time to pass term limits on Cayman politicians; for all sides of the coin if you’ve been an MLA or elected official for more than eight years, you shoild not be allowed to run again. This guy has been at it since 1984!
