Breakdown of Labour Standards and Practicies

The Cayman Islands employment standards, practices and framework are governed by the Labour Law (2007) Revision and its regulations.  This Law gives authority for the establishment of various agencies, which are to assist employees with queries or questions regarding labour protocols. It is sad to see that the mechanisms established to protect, guide and assist the workforce are currently not working effectively.  This is evident, as according to the economics and statistics report local unemployment is currently 9.8%.  

In such a small community the impact is widespread as it affects the employee, their entire family and local businesses. etc  Many readers may say the 9.8% are lazy caymanians not interested in employment.   I beg to differ as there are many qualified caymanians currently unemployed.  Many of these individuals are currently unemployed due to redundancy or being unfairly dismissed from their positions.  Many of these positions are not redundant, in most of these cases one could view the newspaper one week after the redundancy and see the position being advertised or in some instances the organization will hire a temporary person through an employment agency for the same position. Under the law this is not allowed but yet it is still being allowed to happen.

Unemployment is expected in every country however, it is extremely alarming when unemployment keeps increasing and work permits are also increasing at a higher average.  These co-operations are terminating or making individuals redundant for unjustified reasons and are not being held accountable by our laws, the individuals impacted by the decision or the government agencies.   It is so evident to anyone paying attention to the cayman landscape, what is happening within our islands and how unfairly individuals are being treated.

What kind of example is this setting for our future leaders, employees and our children.  It is time for someone including those individuals impacted to stand up and hold these co-operations and agencies accountable.

Do Authorities still actually review Companies' Work Plans ??

A friend of mine worked for a Bank in Cayman where a 'core' area of the Department she worked for comprised a minimum of 3 or 4 long-term Employment Agency positions. some having been there for  years.

These positions could have easily been occupied by Caymanians but as she learned, it was easier for them to maintain an Employment Agency 'core' so that when the Banks' Strategy changed -  they could simply  'add-to' or 'downsize' conveniently without having to be stuck with Caymanians to possibly re-train in different areas. If any didn't work out - they could just drop them - no harm - no foul. and perhaps more importantly... no redundancy !!

If a full-time Caymanian was 'stuck' in the path of their 'changed Strategy' - the Bank would simply orchestrate something in order to unfairly dismiss them.. (No, my friend was not one of them) and often no resistance would be offered as the Bank had deep pockets to assist with their representation.

My friend did write to the Authorities to suggest that they review the Banks' Work Plan  - No response..... they're probably still doing it and it's sad to see that those Caymanians in Management positions there, are often either perpetrators themselves, or just stand back and say nothing . Mind you, the MD was apparently always half-sozzled or Hungover so apathy comes along with that.

We Caymanians are often our own worst enemy - Once we get Senior Level positions, we seem not to want to see our fellow Caymanians climb the ladder - or be on a par with us - we are content  to see the injustices and turn a blind eye especially if we are working for a Foreign Company.   I will often pass on a recommendation for Hiring of someone I used to work with who was 'tried and trusted' but I do not finding the reverse happening - even when your ex-colleagues know you were unemployed.I have always found that the only person you can rely on to give you a helping hand, is yourself...sad, but true...,,,,,,,, Interesting though when 'down the road' those same persons come to you looking for help with getting a job at your place of Work..... (Fortunately, I don't hold grudges and am not vindictive :-)

Gone are the days when Caymanians could (rightly or wrongly) be accused of 'being born with a Silver Spoon in their mouths' – These days we see more and more of our youth working hard to become academically qualified. They study here and abroad, come Home and what… are still often replaced by either Non-Caymanians or Employment Agency workers, without challenge. This happens far too often to be a 'personality mis-match' or whatever excuse people use to justify their comment that 'must've been the better person who got the job' ...... twaddle !

I have, and always will encourage my Caymanian colleagues (especially those working under me) to strive to achieve my position.....

To be fair to those Employers with a preference to hiring from their own Country first,            ( which they will always will try to do whenever they can get away with it ) unfortunately these days, they are also often 'equal-opportunists' when it comes to hiring,using and abusing....once you have served your purpose - they will toss you out- Regardless of Nationality., so that side is not strictly reserved for Caymanians phew !! thanks

Employee/Employer loyalty exists but I think Employer/Employee loyalty is a bit of a 'dinosaur' these days. One is more of a 'commodity' than part of the Corporate 'Family' .

And whoever says that unemployment is a Myth is obviously unaffected by it.

The Cayman ruling class (aka

The Cayman ruling class (aka employers) are the enemy of the Cayman working class.
 
The Cayman ruling class likes using workers on work permits despite the cost. The work permit gives the employer draconian control over the worker.
 
It's all about control.
 
Control and the real threat of immediate deportation guarantees hard work and competence on the part of the expat worker. While many Caymanian workers truly provide hard work and competence, from the employer's view point, there is no guarantee.
 
Remember, all laws in Cayman are enacted by Caymanians who are elected by Caymanians.
 
If you think that the Caymanian MLAs are controlled by outside interests, remember that Caymanians elected them and Caymanians have the power to kick them out of the LA if Caymanians don't like the laws that the MLAs enact.

So let's get the straight.  Because of the inability of those on work permits to move jobs within Cayman, Caymanians suffer in the employment market.  So by this logic, if we end the ability of work permit holding employers to object to an expat getting a new job during the permit, this will help Caymanian employment.  Hands up for those Caymanians who support this change to the law?

You are so right, these employers who claim they are for caymanians, giving us a scholarship here or there for a picture in the paper.  what a joke.  They call us lazy because caymanians finally speaking up for their rights.
They talk about we cant work hard I wonder what they think this island was built on!!!  They need to go back to their country since caymanians are no good!!

Labour Injustices

Listen one and all this is not to be taken lightly it is happening to alot of Caymanians across the board.  Why you may ask ?  This has everything to do with Managers getting ride of Caymanians as they see how easy it is to get ride of employees and there is no real recourse for the employee. These business are taking advantage of our labour force and seems quti unfair and is targeting the Caymanians as a whole.  This is about them meeting their own agendas.  If they have a friend or country man that they want to help out then they will get ride of the Caymanian an get a work permit to replace the position.
People say that Caymanians are lazy and do not want to work.  These milicous lies have been spread in order that the companies can hire cheaper labour and Caymans at large feel this is justified and keep thier mouths shut because they have been told this so long, that we are not as good as our foreign counterparts.  Lies all lies to have you believing what is to their advantage.  Take a good look around you we have many many many educated Caymanian who are still struggling in our own country. Wake up Cayman!  Stop tairing each other down this is the time to UNITE, can't you see that this is a tactic they are using to keep us down. They know that by keeping us divided is to their advantage, Divide and Conquer that is the tactic they have always used on us.  Let us get with the program UNITE is our only way to regain our strength.

Labour Injustices

'Labour Injustices', I agree with what you are saying 99.99% because, as a qualified Caymanian, I have seen this type of thing happen time and time again throughout my Career in the Finance Industry. My first position as a Caymanian was only offered to me because an 'unqualified but smart' Ex-Pat friend of Management was refused a further work-permit renewal and as their understudy, I was graced with the position.
Management then tried to 'create' a position for that person at a more Senior Level......but that's another story....
I can tell you of examples where it has been 'announced' to me as I walked into interview that the Company already has someone earmarked for the position from their Home Country but they have been told by Immigration that they need to Interview more Caymanians....how am I supposed to compete with that (qualified or not qualified)??
I have Interviewed for a promotion for a Managerial position which I had already held for a year successfully - only to be told that it was being offered to someone from Head Office (who it turned out could not be placed in the Home Country so it was more convenient to offer them the Promotion here). I was offered the compromise (very angrily by the MD) that if I did insist on pursuing  the position - it would only be for 2 years ....then 'what would I do??? ...          how long did the Ex-pat - (his personal friend as it turned out) get the position for????? ( 8 Years).
I have seen in my own Workplace a Head of Department from another Country appointed over the acting Caymanian (who had to train him)..... simply because he was a 'golfing-buddy' of the Country Manager. He lasted 3 months and had to quit because he couldn't  'hack-it'.......(he was supposedly qualified but in a totally different discipline than the one he was hired for )....
I have many friends with similar stories so there is absolutely no refuting that this goes on and we are past the days of being frightened of reporting or saying anything ( for fear of reprisals) because we know that even when we go to our representatives/authorities etc..... nothing happens.
The only thing I do ask of you and my Caymanian Brothers and Sisters is ... Please.... if we are to get the point across and sound 'credible'... let's use a 'spell-check' before we post our comments... no offense intended.. but as a qualified Caymanian, I feel I need to demonstrate that I am as equal to any of my 'foreign' counterparts in both 'deed' AND word.
Otherwise, I am with you all the way ....  I have a long career and have the examples to prove it. (and God help me if my 'spell-check' didn't work) :-)
